Ordinance No.
AN ORDINANCE APPROPRIATING $16,99500 TO THE PROPERTY AND CASUALTY INSURANCE
FUND, AND DECREASING THE UNRESERVED, UNDESIGNATED PROPERTY AND CASUALTY
INSURANCE FUND BALANCE BY THE SAME AMOUNT FOR THE PURPOSE OF PROVIDING FUNDING
FOR THE REPAIR OR REPLACEMENT OF DAMAGED ART OBJECTS IN THE JAPANESE GARDENS OF
THE BOTANIC GARDENS, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT
HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1.
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1996-97 and in the Budget of the City
Manager, there shall also be increased appropriations in the Property and Casualty Insurance Fund, in the amount of $16,995 00;
thereby decreasing the unrestricted, undesignated Fund Balance by the same amount, for the purpose providing funding the repair or
replacement of damaged art objects in the Japanese Gardens of the Botanic Gardens.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of
competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of
sections of this ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 12629 and all other ordinances and appropriations amending the same
except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,
in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect and after the date of its passage, a~1d it is so ordained.

TO THE PARKS AND COMMUNITY SERVICES DEPARTMENT, BOTANIC GARDEN
RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached supplemental appropriation ordinance increasing appropriations by
516,995 00 in the Property and Casualty Insurance Fund and decreasing the unreserved,
undesignated fund balance, and
2 Authorize the City Manager to transfer 516,995 00 from the Property and Casualty
Insurance Fund to the General Fund, and
3 Adopt the attached supplemental appropriation ordinance increasing estimated receipts and
appropriation by 516,995 00 in the General Fund, for the Parks and Community Services
Department, from available funds
DISCUSSION
A claim payment from the Phoenix Assurance Company of New York, the insurer for the City's
fine arts coverage in fiscal year 1994-95, was received October 25, 1995, in the amount of
516,995 00 to cover the May 5, 1995 hail storm damage to insured outdoor art objects located
in the Japanese Garden of the Botanic Garden The insurance provided recovery on a
replacement cost/scheduled value for four (4) hail-damaged pagodas and lanterns and the
negotiated and agreed claim settlement allowed the City to retain the damaged objects
However, as the objects were gifts from the Fort Worth Botanic Society, it is staff's intention to
procure comparable new objects of like kind and quality to replace the damaged items, largely
with proceeds from the insurance company

The Director of Fiscal Services certifies that upon adoption of the attached supplemental
appropriations ordinances, funds required for replacement of the objects will be available in the
current operating budget, as appropriated, of the General Fund
