ORDINANCE NO ~~~~
AN ORDINANCE AMENDING CHAPTER 22 "MOTOR VEHICLES AND
TRAFFIC", OF THE CODE OF THE CITY OF FORT WORTH (1986), AS
AMENDED BY AMENDING SUBSECTION (f) OF SECTION 22-86 OF
ARTICLE III THEREOF BY CHANGING CERTAIN SCHOOL ZONES AND
THE TIME SCHOOL ZONES ARE IN EFFECT, PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL PROVISIONS OF
ORDINANCES AND OF SUCH CODE AFFECTING MOTOR VEHICLES
AND TRAFFIC• PROVIDING A SAVINGS CLAUSE, PROVIDING A
SEVERABILITY CLAUSE, AUTHORIZING PUBLICATION IN PAMPHLET
FORM, DIRECTING THE PUBLICATION OF THE CAPTION, PENALTY
CLAUSE AND THE EFFECTIVE DATE OF THIS ORDINANCE,
PROVIDING A PENAL CLAUSE, AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That the first .paragraph of Subsection (f) of Section 22-$6 of the Code of the City
of Fort Worth (1986), as amended, is hereby amended to be and read as follows:
On that portion of those streets or highways being designated as a school
zone, the prima facie maximum and reasonable and prudent speed in miles
'per hour as posted Monday through Friday when school is in session, shall
be such speed as indicated below, provided that an appropriate sign giving
notice thereof is erected Such sign will have posted time of operation or a
sign indicating the prima facie maximum speed when flashing,
accompanied by a flashing light. The times of operation of each school
zone shall be set by the City Traffic Engineer It shall be an affirmative
defense to a charge of exceeding the prima facie maximum speed limit,
established below, that the day in question was a day when there were no
classes in session at the nearest school within two thousand (2,000) feet of
the location of such alleged excessive speeding.
SECTION 2
The listing of school zones contained in Subsection (f) of Section 22-86 of the
Code of the City of Fort Worth (1986), as amended, is hereby amended by deletin the
following locations

SECTION 4
That this ordinance shall be cumulative of all provisions of ordinances and of the
Code of the City of Fort Worth (1986), as amended, affecting motor vehicles and traffic,

except where the provisions of this ordinance are in direct conflict with the provisions of
such ordinances and such Code, in which event such conflicting provisions of such
ordinances and such Code are hereby repealed.
SECTION 5
That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as
to any and all violations of the provisions of Chapter 22 of the Code of the City of Fort
Worth (1986), as amended, and of any other ordinance affecting motor vehicles which
have accrued at the time of the effective date of this ordinance, and, as to such accrued
violations, and all pending litigation, both civil or criminal, whether pending in court or not,
under such chapter and/or other ordinances same shall not be affected by this ordinance
but may be prosecuted until final disposition by the courts.
SECTION 6
That it is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared void,
ineffective or .unconstitutional by the valid judgment or decree of any court of competent
jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since
the same would have been enacted by the City Council without the incorporation in this
ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section
SECTION 7
This ordinance may be published in pamphlet form for general distribution among the
public, and the operative provisions of this ordinance as so published shall be admissible
in evidence in all courts without further proof than the production thereof, as provided in
Chapter XXV, Section 3, of the charter of the City of Fort Worth, Texas.
SECTION 8
That the City Secretary of the City of Fort Worth, Texas is hereby directed to
publish the caption, penalty clause and effective date of this ordinance for five (5) days in
the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013,
Texas Local government Code
SECTION 9
That any person violating any of the provisions of this ordinance shall be deemed
guilty of a misdemeanor, and each such person shall be deemed guilty of a separate

offense for each day or portion thereof during which any violation of any of the provisions
of this ordinance is committed, continued of permitted, and each violation shall be
punishable by a fine not to exceed Two Hundred Dollars {$200 00)
SECTION 10
That this ordinance shall be in full force and effect from and after the date of its
passage and publication as required by law, and it is so ordained.

si7sJECT AMENDMENT TO SPEED ZONE ORDINANCE
RECOMMENDATION
It is recommended that City Council approve certain amendments in the City's Speed Zone
Ordinance, Chapter 22 of the City Code, section 22-86 (f) by adopting the attached ordinance
DISCUSSION
The attached proposed ordinance amends the City of Fort Worth speed zone ordinance Chapter
22, City Code, section 22-86 (f) by making certain additions and deletions recommended by the
Department of Transportation and Public Works These amendments are necessary in order to
include changes in the school zone limits for which a need has occurred since the last ordinance
was passed
The attached ordinance reflects changes in the limits of School Zones within the city limits of
Fort Worth Deletions listed reflect changes due to the installation of flashing school zone signs
or indicate corrections to typographical errors which occurred during the printing of the last
change in the ordinance
Included in this ordinance is an amendment to delete the reference to specific times during which
the school zone speed limits may be in effect The new change permits school zone flashing
lights to be on at any specific, posted time Monday through Friday This action is necessary
because of the twelve (12) month school year and extended school hours
