'9 ORDINANCE NO ~~~~ AN ORDINANCE AMENDING CHAPTER 22 "MOTOR VEHICLES AND TRAFFIC", OF THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED BY AMENDING SUBSECTION (f) OF SECTION 22-86 OF ARTICLE III THEREOF BY CHANGING CERTAIN SCHOOL ZONES AND THE TIME SCHOOL ZONES ARE IN EFFECT, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PROVISIONS OF ORDINANCES AND OF SUCH CODE AFFECTING MOTOR VEHICLES AND TRAFFIC• PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AUTHORIZING PUBLICATION IN PAMPHLET FORM, DIRECTING THE PUBLICATION OF THE CAPTION, PENALTY CLAUSE AND THE EFFECTIVE DATE OF THIS ORDINANCE, PROVIDING A PENAL CLAUSE, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That the first .paragraph of Subsection (f) of Section 22-$6 of the Code of the City of Fort Worth (1986), as amended, is hereby amended to be and read as follows: On that portion of those streets or highways being designated as a school zone, the prima facie maximum and reasonable and prudent speed in miles 'per hour as posted Monday through Friday when school is in session, shall be such speed as indicated below, provided that an appropriate sign giving notice thereof is erected Such sign will have posted time of operation or a sign indicating the prima facie maximum speed when flashing, accompanied by a flashing light. The times of operation of each school zone shall be set by the City Traffic Engineer It shall be an affirmative defense to a charge of exceeding the prima facie maximum speed limit, established below, that the day in question was a day when there were no classes in session at the nearest school within two thousand (2,000) feet of the location of such alleged excessive speeding. SECTION 2 The listing of school zones contained in Subsection (f) of Section 22-86 of the Code of the City of Fort Worth (1986), as amended, is hereby amended by deletin the following locations Street Craig Street Block Numbers 5800-6050 Mitchell Boulevard 3600-3900 Putnam Street 2600-2800 Extent Maximum Speed 70' east of Canton Drive to 390 feet east 20 of Putnam Street Lowiemore Lane to 120 feet south of 20 Moresby Street South property line of 2708 to south 20 property line of 2833 Putnam Street SECTION 3 The listing of school zones contained in Subsection (f) of Section 22-86 of the Code of the City of Fort Worth (1986), as amended, is hereby amended by addin the following locations Street Block Extent Maximum Numbers Speed Basswood Boulevard 3900-4100 315 feet west of Buttonwood Drive to-210 20 feet east of Buttonwood Drive Calmont Avenue 8200-8300 330 feet east of Mojave Trail to 220 feet 20 west of Mojave Trail Craig Street 5900-6050 220 feet west of Putnam Street to 295 feet 20 east of Putnam Street Mitchell Boulevard 3600-3900 Lowriemore Lane to 120 feet south of 20 Moresby Street Putnam Street 2700-2800 435 feet north of Beaty Street to 325 feet 20 south of Beaty Street Summerfields Boulevard 3900-4100 200 feet west of Buttonwood Drive to 350 20 east of Buttonwood Drive Summerfields Boulevard 3800-4000 420 feet west of Fox Chase Drive to 360 20 feet east of Fox Chase Drive Thompson Road 3900-4100 220 feet west of Heritage Place to 450 feet 20 east of Heritage Place Thompson Road 4200-4400 260 feet west of Heritage Way to 380 feet. 20 east of Heritage Way SECTION 4 That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth (1986), as amended, affecting motor vehicles and traffic, 2 ,~ except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event such conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5 That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Chapter 22 of the Code of the City of Fort Worth (1986), as amended, and of any other ordinance affecting motor vehicles which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations, and all pending litigation, both civil or criminal, whether pending in court or not, under such chapter and/or other ordinances same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 6 That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or .unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section SECTION 7 This ordinance may be published in pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof, as provided in Chapter XXV, Section 3, of the charter of the City of Fort Worth, Texas. SECTION 8 That the City Secretary of the City of Fort Worth, Texas is hereby directed to publish the caption, penalty clause and effective date of this ordinance for five (5) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013, Texas Local government Code SECTION 9 That any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate 3 ': offense for each day or portion thereof during which any violation of any of the provisions of this ordinance is committed, continued of permitted, and each violation shall be punishable by a fine not to exceed Two Hundred Dollars {$200 00) SECTION 10 That this ordinance shall be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained.
