SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $5,904 00 FOR THE PURPOSE OF FUNDING A CONTRACT WITH TURNER COLLIE & BRADEN, INC , FOR STREET RECONSTRUCTION AND WATER AND SANITARY SEWER REPLACEMENTS IN ROBERT STREET E , JUDD STREET, VICKI LANE, AND ASH CRESCENT STREET; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1995-96 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $22,398 00 and in the Sewer Capital Projects Fund in the amount of $5,904 00 for the purpose of funding a contract with Turner Collie & Braden, Inc for street reconstruction and water and sanitary sewer replacements in Robert Street E Judd street, Vicki Lane, and Ash Crescent Street SECTION 2 ti;Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect SECTION 3 That this ordinance shall be cumulative of Ordinance No 12074 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed ` SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to transfer 528,302 00 from the Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of 522,398 00 and the Sewer Capital Projects Fund in the amount of 55,904 00, and 2 Adopt the attached appropriations ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of 522,398 00 and the Sewer Capital Projects Fund in the amount of 55,904 00 from the increased revenue, and 3 Authorize the City Manager to execute an engineering agreement with Turner Collie & Braden, Inc , for a fee not to exceed 5100 000 00 to prepare plans and specifications for street, water and sanitary sewer improvements on Robert Street E (Mississippi to New York), Judd Street (I-35W Service Road to Mississippi), Vicki Lane (Evans to Mississippi) and Ash Crescent (Clovis to Belzise Terrace) DISCUSSION The 1993 Capital Improvement Program included funds for the reconstruction of Robert Street E (Mississippi to New York), Judd Street (I-35W Service Road to Mississippi), Vicki Lane (Evans to Mississippi) and Ash Crescent (Clovis to Belzise Terrace) The Water Department has determined that the water and sewer lines in the project area require replacement prior to reconstruction of the streets Turner Collie & Braden, Inc ,located at 1200 Summit Avenue, Fort Worth, Texas 76102, proposes to perform the design work for this project for a fee not to exceed 5100,000 00 based on established hourly rates Staff considers this fee to be fair and reasonable for the scope of services proposed Turner Collie & Braden, is in compliance with the City's M/WBE ordinance by committing to 20% M/WBE participation The City's goal for this project was
