ORDINANCE NO. ~Q;C~/r.~ AN ORDINANCE OF THE CITY OF FORT WORTH PROVIDING FOR THE INTERIM APPOINTMENT OF THE FORT WORTH HEALTH AUTHORITY; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the resignation of the Director of the Public Health Department of the City of Fort Worth will be effective September 12, 1996; and WHEREAS, pursuant to statute the outgoing director also acted as the health authority of the City of Fort Worth; and WHEREAS, the appointment of an interim health authority is necessary in order that the City of Fort Worth may establish, maintain, and enforce quarantine within the City; report the presence of contagious, infectious, and dangerous epidemic diseases in the city to the Texas Board of Health; and enforce sanitation laws, quarantine rules, and vital statistics collection within the City; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. Dr. Alecia Hathaway, M.D., a competent physician with a reputable professional standing, who is legally qualified to practice medicine in the State of Texas, and who is a resident of the State of Texas, is hereby appointed health authority of the City of Fort Worth on an interim basis, effective September 12, 1996, to serve until the appointment by the City Manager of a new director of the Fort Worth Public Health Department, unless sooner removed by a majority vote of the City Council. Dr. Hathaway shall take the official oath of office as required by Section 121.022 (b } (1 } of the Texas Health and Safety Code, and shall file a copy of the oath and this appointment with the Texas Board of Health. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986) , as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconsti- tutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of any ordinances affecting the health authority of the City of Fort Worth which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 5. This ordinance shall be in full force and effect from and after its passage as required by law.
