AN ORDINANCE INCREASING TIIE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
SPECIAL ASSESSMENT FUND IN THE AMOUNT QF $77,389.36 FOR THE PURPOSE OF
FUNDING A CONTRACT WITH MCCLENDON CONSTRUCTION COMPANY, INC., FOR
RECONSTRUCTION OF MISSISSIPPI AVENUE, PROVIDING FOR A SEVERABILITY CLAUSE,
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL
PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1.
That in addition to those amounts allocated to the various City departments for the Fiscal Year 1995-96 and in the Budget
of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Assessment Fund
in the amount of $77,389.36 for the purpose of funding a contract with McClendon Construction Company, Inc., for
reconstruction of Mississippi Avenue.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by
a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions,
sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and
effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 12074 and all other ordinances and appropriations amending
the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances
and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby
expressly repealed.
SECTION 4
This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained.

RECOMMENDATION
It is recommended that the City Council
1 Adopt the attached appropriation ordinance increasing estimated receipts and
appropriations by 577,389 36 in the Special Assessments Fund and 577,389 36 in
the Street Improvements Fund from available funds, and
2 Approve a $77,389 36 fund transfer for the property owner's share of construction
costs from the Special Assessments Fund to the Street Improvements Fund, and
3 Approve an 589,074 67 fund transfer from the Streets Assessment Project to the
Street Construction Project in the Grants Fund, and
4 Authorize the City Manager to execute a contract with McClendon Construction
Company, Inc , in the amount of S296,915 55 and seventy (70) working days for
the reconstruction of Mississippi Avenue from E Berry Street to Glen Garden Drive
DISCUSSION
The 1990 Capital Improvement Program included funds for the improvement of Mississippi
Avenue from E Berry to Glen Garden The street has not previously been constructed to
City standards Community Development Block Grant (CDBG) funds will provide a portion
of the construction costs
On February 23, 1993 (M&C BH-01 17~, the City Council held a benefit hearing and levied
assessments for this project
The street improvements will include the construction of standard concrete pavement,
driveway approaches, and sidewalks where shown on the plans
This project was advertised on June 13 and 20, 1996 The following bids were received
on July 1 1, 1996
