HomeMy WebLinkAboutOrdinance 12341ORDINANCE NO. ~~ 3 ~( AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING A PORTION OF A STREET RIGHT-OF-WAY LOCATED WITHIN THE HEIRS OF W W THOMPSON SURVEY, ABSTRACT NO 1498, AND THE MILLEY GILBERT SURVEY, ABSTRACT NO 565, TO THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF THE CITY'S RIGHT, TITLE AND INTEREST IN SAID LAND; PROVIDING FOR A CONDITION PRECEDENT TO THE OCCURRENCE OF THE SAME, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT subject to the occurrence of the condition prescribed in Section 3 hereof, the segment of Old Denton Road beginning one thousand and ten (1,010) feet north of Western Center Boulevard and extending northward for a length of one-thousand, two- hundred and eighty (1,280) feet, as said road is located adjacent to the Heirs of W W Thompson Survey, Abstract No. 1498, and the Milley Gilbert Survey, Abstract No 565, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated, abandoned and permanently closed and extinguished. SECTION 2. That subject to the occurrence of the condition presribed in Section 3 hereof, all the City's right, title and interest in and under the above described vacated street right-of-way is hereby released and shall revert to the property owner of the fee simple title to the land as provided by law SECTION 3 That the vacation, abandonment, closure and extinguishment of the above described portion of the street right-of-way, and the release and reversion of the City's right, title and interest in and to the land therein, shall be subject to and conditioned upon the acceptance by the City of Fort Worth of the paving improvements for Fossil Park Drive as located between Old Denton Road to the west and North Riverside Drive to the east SECTION 4 That afl ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5 That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained.
