AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING NINE (9) STREET RIGHTS-OF-WAY ALONG LIDCOTE AVENUE, ROMNEY TERRACE, OVERHILL TERRACE, UNNAMED STREET, GIBBON STREET, STADIUM DRIVE, BOYD AVENUE, HIGHVIEW TERRACE, WALSH AVENUE, AND THREE (3) FIFTEEN (15) FOOT WIDE ALLEY RIGHTS-OF-WAY LOCATED WITHIN THE UNIVERSITY PLACE ADDITION; OF THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR THE REVERSION AND RELEASE OF THE CITY'S RIGHT, TITLE AND INTEREST IN SAID LAND, PROVIDING FOR CONDITIONS PRECEDENT TO THE OCCURRENCE OF SAME; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS' SECTION 1 THAT subject to the occurrence of the conditions prescribed in Section 3 hereof, the following street and alley rights-of-way specifically described in Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned, permanently closed and extinguished 1) Lidcote Avenue 70 foot wide street right-of-way, Blocks 25 and 23, Bellaire (Between Romney Terrace to the west and Stadium Drive to the east), 2) Romney Terrace Variable width right-of-way, Block 23, 24 and 25, Bellaire (Between Bellaire Drive North to the south and Overhill Terrace to the north), 3) Overhill Terrace Variable width right-of-way, Block 25 & 27, Bellaire (Between Bellaire Drive North to the south and Romney Terrace to the north), 4) Unnamed Street: 30 foot wide street right-of-way, Block 24, 28 and 27, Bellaire, and blocks 17, 19, 20 and 21, University Place Addition (Between the east line of Colonial Park subdivision to the west and Stadium Drive to the east), 5) Gibson Street: Variable width right-of-way, Blocks 17, 19, 20 and 21 thru 25, University Place Addition (Between the east. line of Colonial Park subdivision to the west and Stadium Drive to the east), 6) Stadium Drive Variable width right-of-way, abutting the west lime of the existing Stadium Drive right-of-way and situated adjacent to Blocks 26 and 27, Bellaire, and Blocks 17 and 25, University Place Addition (Between Overhill Terrace to the south and Cantey Street to the north), 7) Boyd Avenue 60 foot right-of-way, Blocks 17, 19, 27 and 28, Bellaire, and Lots 13 thru 16, Block 24, Lots 12 thru 9, Block 25, University Place Addition (Between Overhill Terrace to the south and Cantey to the north), 8) Highview Terrace 60 foot right-of-way, Blocks 19 and 20, Bellaire, and Lots 13 thru 16, Block 23, Lots 12 thru 9, Block 24, University Place Addition (Between Overhill Terrace to the south and Cantey Street to the north), 9) Walsh Avenue 60 foot right-of-way, Blocks 20 and 21, Bellaire, and Lots 9 thru 12, Block 22, Lots 9 thru 12, Block 23, University Place 2 Addition (Between the north right-of-way line of 30 foot wide unnamed street to the south and the north right-of-way line of Cantey Street to the north), 10) 15-Foot Wide Alley Right-Of-Way• Block 17, University Place Addition, and Lots 13 thru 15 and 10 thru 12, Block 25, University Place Addition (Between north right-of-way line of 30 foot wide unnamed street to the south and Cantey Street to the north); 11) 15-Foot Wide Alley of Right-Of-Way• Block 19, University Place Addition, and Lots 13 thru 15 and 10 thru 12, Block 24, University Place Addition (Between north right-of-way line of 30 foot wide unnamed street to the south and Cantey Street to the north), 12) 15-Foot Wide Alley Right-Of-Way• Block 20, University Place Addition, and Lots 13 thru 15 and 10 thru 12, Block 23, University Place Addition (Between north right-of-way line of 30 foot wide unnamed street to the south and Cantey Street to the north) SECTION 2. That subject to the occurrence of the conditions prescribed in Section 3 hereof, all the City's right, title and interest in and to the land in and under the above described street and alley rights-of-way is released and shall revert to the property owner of the fee simple title to the land as provided by law SECTION 3. That the vacation, abandonment, closure and extinguishment of the above described portions of the street and alley rights-of-way, and the release and reversion 3 of the City's right, title, and interest in and to the land therein, shall be subject to and conditioned upon (i) the approval of the final plat by the City Plan Commission, and (ii) the filing of said final plat in the Tarrant County Plat Records on or before January 30, 1997 In the event such final plat is approved and filed for record in the Tarrant County Plat Records within the prescribed time, then a copy of said final plat shall be attached as Exhibit "B" to this ordinance, as same is filed in the office of the City Secretary of the City of Fort Worth, and the attachment of said final plat as Exhibit "B" shall constitute conclusive evidence of the occurrence of such conditions In the event said plat is not approved by the City and filed in the Tarrant County Plat Records on or before January 30, 1997, then this ordinance shall become null and void, the same as if it had never been adopted, and the vacation, abandonment, closure and extinguishment of the street and alley rights-of-way, and the release and reversion of the right, title and interest in and to the land therein shall not take effect. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 5.
