HomeMy WebLinkAboutOrdinance 12456ORDINANCE NO. °~~ AN ORDINANCE AMENDING CITY OF FORT WORTH ORDINANCE NO. 11923, BY AMENDING SECTION 8 TO CREATE THE MINORITY AND WOMEN'S BUSINESS ENTERPRISE ADVISORY COMMITTEE; SPECIFYING DUTIES; ESTABLISHING TERMS FOR MEMBERS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF PRIOR ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE 'CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 8 of Ordinance No. 11923, the Minority Business Enterprise and Women Business Enterprise Ordinance, is hereby amended, and after having been so amended, shall be and read as follows: a ) The City Manager, with the advice and counsel of the Minority and Women Business Enterprise Advisory Committee (M/WBEAC) which is hereinafter created, is hereby authorized to establish, implement and administer regulations necessary to carry out the intent of this ordinance. b) The rM/WBEAC is hereby formed to monitor this ordinance and to provide continuing input to the City Council on the progress of the MBE/WBE program. The M/WBEAC shall serve in an advisory capacity to the City Council, and shall assist the City Manager in implementing the program. c } The M/WBEAC shall be composed of a total of thirteen (13) members, consisting of one representative each from the five (5) Chambers of Commerce, two (2) certified MBEs, two (2) certified WBEs, and four (4) representatives of professional organizations. The members shall be appointed by the City Council for a term of two (2) years. No member shall serve more than three (3) consecutive terms. A chairperson shall be elected by a majority of members at the first official meeting. SECTION 2. Ordinance No. 11923 is hereby further amended by changing any reference to the DBEAC in the Ordinance to the MIWBEAC. SECTION 3. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention bf the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained.
