ORDINANCE NO.
AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING
ORDINANCE, ORDINANCE NO 3011, AS AMENDED, SAME BEING AN
ORDINANCE REGULATING AND .RESTRICTING THE LOCATION AND
USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE,
INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER
OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE
SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING
AND LOADING, AND THE DENSITY OF POPULATION, AND FOR SUCH
PURPOSES DIVIDING THE MUNICIPALITY INTO DISTRICTS OF SUCH
NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO
CARRY OUT THESE REGULATIONS AND SHOWING SUCH DISTRICTS
AND THE BOUNDARIES THEREOF UPON "DISTRICT MAPS",
PROVIDING FOR INTERPRETATION, PURPOSE AND CONFLICT,
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
ORDINANCES, PROVIDING A SAVINGS CLAUSE, PROVIDING A
SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING
FOR PUBLICATION AND NAMING AN EFFECTIVE DATE
SECTION 1
That Ordinance No 301 1, as amended, be and is hereby amended so that the
permitted uses in the hereinafter described areas be altered, changed, and
amended as follows
Z-95-090 Block 47, Lots 7, 8, 9, and Blocks 15,16,17 and 18, Fostepco

From "J" Light Industrial and "K" Heavy Industrial to "PD/SU"

From "C" Multi-Family to "PD/SU" Planned Development/Specific Use

1 FIRE ACCESS/STATLER BLVD -For the purpose of fire access,
a fire lane/access easement shall be provided to the Fort Worth
Fire Department from existing Statler Boulevard to either Trinity
Boulevard or Buckingham Road at the time of final platting of the
property adjacent to the Fire Station Site At that time, an
automatic security gate shall be installed by the developer at the
existing terminus of Statler Boulevard with full operational
capability provided to the Fort Worth Fire Department.
2 USE RESTRICTIONS -With respect to any tract located adjacent to
existing multi-family development, determined as of the time of the
request for a building permit, the following use restrictions shall
apply, (a) no outside storage shall be permitted within one hundred
fifty (150) feet of the adjacent multi-family development nor be
visible from any location within the adjacent multi-family development,
(b) no use shall be allowed which is offensive by reason of odor, fumes,

dust, smoke, noise or pollution or which constitutes a nuisance or is
hazardous by reason of fire or explosion or is injurious to the reputation
of any adjacent multi-family development, and (c) the following uses
shall not be allowed

3 LANDSCAPE BUFFER -With respect to any tract having a common boundary
with an existing multi-family development, determined as of the time of the
request for a building permit, the following landscaping requirements shall
apply, (a) a forty (40) foot landscaped buffer shat{ be provided along the
common boundary by the developer, (bl the landscaping within the buffer
area shall be maintained in a manner consistent with common areas located
within the CentrePort development; (c) the landscaping within the buffer area
shall be fully irrigated and include an earthen berm (at least 4' height) and a
continuous line of evergreen trees lat least 5" caliper) of a quality consistent
with the trees in the common areas of CentrePort spaced so as to provide a
solid vegetative screen at the time of maturity (no more than 15' spacing
depending on tree species), and (d) any fencing placed within the buffer area
shall be wrought iron or a combination wrought iron and masonry

4 LOADING -With respect to any tract having a common boundary with an
existing multi-family development, determined as of the time of a request for a
building permit, the following loading requirements shall apply, (a) no loading
docks shall face the adjacent. to existing multi-family development, (b) loading
docks, loading or truck maneuvering for the purpose of loading shall not be
permitted within two hundred (200) feet of the multi-family property line
5 BUILDING HEIGHTS/SETBACKS -With respect to any tract located adjacent to
existing multi-family development, as determined as of the time of the request
for a building permit, building heights shall be restricted to a maximum of thirty
{30) feet at the fifty (50) foot setback line (measured from the common
boundary line with the existing multi-family development) Any building
exceeding thirty (30) feet shall require two (2) additional feet of setback for
each one (1) foot of additional building heights
6 SITE LIGHTING -With respect to any tract located adjacent to amulti-family
development, determined as of the time of a request for the building permit, the
following requirements for site lighting shall apply (a) all site lighting shall be
oriented away from the multi-family development, and (b) lighting foot candles
shall not be of an intensity so as to disturb occupants in the adjacent multi-
family development
7 FINAL SITE PLAN REQUIREMENT -Final Site Ptan approval shall be required
with respect to any tract located adjacent to an existing multi-family
development, as determined at the time of request for final site plan approval
All other site plan requirements are waived
8 DEED RESTRICTIONS - At or before the time of the filing of the Final Pfat for
Area 2, Section 4 of CentrePort, the developer shall record Supplementary
Declaration No 10 in the form attached covering Area 2, Section 4

SECTION 2.
That the zoning regulations and districts, as herein established, have been made in
accordance with the comprehensive plan for the purpose of promoting the health,
safety, morals and general welfare of the community They have been designed to
lessen congestion in the streets, to secure safety from fire, panic, flood and other
dangers, to provide adequate light and air, to prevent overcrowding of land, to avoid
undue concentration of population, to facilitate the adequate provisions of
transportation, water, sewerage, parks and other public requirements They have
been made after full and complete public hearing with reasonable consideration,
among other things, of the character of the district and its peculiar suitability for the
particular uses and with a view of conserving the value of a building and encouraging
the most appropriate use of land throughout the community
SECTION 3
That this ordinance shall be cumulative of all other ordinances of the City of Fort
Worth affecting zoning and shall not repeal any of the provisions of such ordinances,
except in those instances where provisions of such ordinances are in direct conflict
with the provisions of this ordinance
SECTION 4.
That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to
any and all violations of Ordinance No 3011 or of any amendments thereto that have
accrued at the time of the effective date of this ordinance, and as to such accrued
violations, and all pending litigation, both civil or criminal, same shall not be affected
by this ordinance but may be prosecuted until final disposition by the courts
SECTION 5
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
void, ineffective or unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation herein of any such void, ineffective or unconstitutional phrase, clause,
sentence, paragraph or section
SECTION 6
That any person, firm or corporation who violates, disobeys, omits, neglects or refuses
to comply with or who resists the enforcement of any of the provisions of this
ordinance shall be fined not more than Two Thousand Dollars (52000 00) for each
offense Each day that a violation is permitted to exist shall constitute a separate
offense
SECTION 7.
That the City Secretary of the City of Fort Worth, Texas is hereby directed to publish
this ordinance for two (2) days in the official newspaper of the City of Fort Worth,
Texas, as authorized by V T C A Local Government Code Subsection 52 013
SECTION 8
That this ordinance shall be in full force and effect from and after the date of its
passage and publication as required by law, and it is so ordained
