AN ORDINANCE PROVIDING FOR THE CHANGING OF A
PORTION OF THE CORPORATE BOUNDARIES OF THE
CITY OF FORT WORTH AND THE CITY OF KENNEDALE
BY DISANNEXING AND DISCONTINUING FROM THE
CORPORATE LIMITS OF THE CITY OF FORT WORTH AN
AREA OF LAND WHICH CONTAINS THE ACCESS ROAD
FOR EASTBOUND INTERSTATE 20 BETWEEN
BUSINESS 287 TO THE WEST AND VILLAGE CREEK TO
THE EAST, SO THAT SAID AREA THEREAFTER MAY BE
ANNEXED BY THE CITY OF KENNEDALE, PROVIDING
THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR
ORDINANCE IN CONFLICT HEREWITH, PROVIDING
THAT THIS ORDINANCE SHALL BE CUMULATIVE OF
ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT,
PROVIDING FOR SEVERABILITY, AND NAMING AN
EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
That, in accordance with and subject to that certain Joint Resolution and
Agreement between the City of Fort Worth and the City of Kennedale, a copy of which
is attached hereto and expressly made a part hereof, the following described land within
the corporate limits of the City of Fort Worth is hereby disannexed and discontinued as
apart of the City of Fort Worth, Texas, said land being described as follows
That portion of the access road for eastbound Interstate 20
between Business 287 to the west and Village Creek to the
east, said land being illustrated and depicted on Exhibit "A",
attached hereto and incorporated herein for all purposes.
That the above described disannexation and discontinuation of land from the corporate
limits of the City of Fort Worth is for the express purpose of changing the boundaries of
the two cities pursuant to the provisions of Section 43.031 of the Texas Local
Government Code
SECTION 2
That this ordinance shall and does amend every prior ordinance in conflict
herewith, but as to all other ordinances or sections of ordinances not in direct conflict,
this ordinance shall be, and the same is hereby made cumulative
SECTION 3
tt is hereby declared to be the intent of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in this ordinance of any
unconstitutional phrase, clause, sentence, paragraph or section
SECTION 4
That this ordinance shall be in full force and effect from and after the date of its
passage by the City Council, and it is so ordained

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance providing for the changing
of a portion of the corporate boundaries of the City of Fort Worth and the City of Kennedale, by
disannexing and discontinuing from the corporate limits of the City of Fort Worth an area of land
which contains the access road for eastbound Interstate 20 between Business 287 to the west
and Village Creek to the east, so that said area thereafter may be annexed by the City of
Kennedale
DISCUSSION
On August 13, 1996, the City Council, pursuant to M&C C-15606 adopted a Joint Resolution
and Agreement between the City of Fort Worth and the City of Kennedale The Joint Resolution
and Agreement provided, among other things, for the changing of a portion of the corporate
boundaries of the City of Fort Worth and the City of Kennedale Specifically, the City of Fort
Worth agreed to disannex from its corporate limits an area of land which contains the access
road for eastbound Interstate 20 between Business 287 to the west and Village Creek to the
east, so that this area then may be annexed by the City of Kennedale The specific area to be
disannexed by the City of Fort Worth and annexed by the City of Kennedale is shown on Exhibit
"A" of the attached ordinance
Adoption of the attached ordinance by the City of Fort Worth is necessary for compliance with
the terms of the Joint Resolution and Agreement
FISCAL INFORMATION/CERTIFICATION
Approval of the attached ordinance will not require the expenditure of the City of Fort Worth
funds
