AN ORDINANCE AMENDING ORDINANCE NO. 12628, WHICH
AMENDED THE COMPREHENSIVE ZONING ORDINANCE OF THE
CITY OF FORT WORTH, BEING ORDINANCE NO. 3011, AS
AMENDED, CODIFIED AS APPENDIX "A" OF THE CODE OF THE CITY
OF FORT WORTH (1986), AS AMENDED, CONCERNING ZONING AND
DESIGN OF MULTI-FAMILY DWELLINGS, AMENDING SECTION 16A
OF THE COMPREHENSIVE ZONING ORDINANCE TO CORRECTLY
IDENTIFY AN EXHIBIT TO SECTION 16A; AMENDING SECTION 2-H,
"'PD' PLANNED DEVELOPMENT DISTRICT" TO PROVIDE FOR "PD"
PLANNED DEVELOPMENT ZONING FOR MIXED RESIDENTIAL AND
NONRESIDENTIAL USES AND FOR MULTI-FAMILY USES IN OR
ADJACENT TO CERTAIN DEFINED EMPLOYMENT AREAS;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR
PUBLICATION IN THE OFFICIAL NEWSPAPER, AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Council adopted Ordinance No 12628 on August 13, 1996,
amending Sections 1, 8, 8A, 8B, 16, 16A, 17, 18 and 19 of the Comprehensive Zoning
Ordinance concerning zoning and development of multi-family dwellings,
WHEREAS, the amendments adopted by the City Council were proposed by a
multi-family task force appointed by the Council, after conducting public meetings and
soliciting public comment and were recommended for approval by the Zoning
Commission on August 1, 1996,
WHEREAS, the ordinance considered by the City Council at its August 13, 1996
meeting included proposed amendments to Section 2-H, "'PD" Planned Development
District", providing for "PD" Planned Development zoning for mixed residential and
nonresidential uses and for multi-family uses in defined areas in or adjacent to
designated employment districts,

WHEREAS, the City Council continued consideration of the proposed
amendments to Section 2-H of the Comprehensive Zoning Ordinance to September 3,
1996 to allow the task force to receive additional public input and to consider such
proposed amendments further;
WHEREAS, the task force considered and suggested revisions to the proposed
Planned Development provisions at its August 21, 1996 meeting,
WHEREAS, it is necessary to amend Section 11 of Ordinance No 12628 to
correctly identify an exhibit to the ordinance, consisting of a diagram of examples of
building orientations,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS THAT ORDINANCE NO. 12628 BE AMENDED TO
AMEND SECTION 11 AND TO ADD PROVISIONS CONCERNING PLANNED
DEVELOPMENT DISTRICT ZONING, AS FOLLOWS:
SECTION 1
Section 11 of Ordinance No 12628, which amended Section 16A, "Unified
Residential Development Provisions", of Ordinance No 3011, the Comprehensive
Zoning Ordinance of the City of Fort Worth, is hereby amended to identify the
diagram of building orientations attached thereto as Exhibit "16A (1)" A copy of such
diagram is attached hereto as Exhibit "16A(1)"
SECTION 2.
Section 2-H, "PD" Planned Development District", of Ordinance No 3011, the
Comprehensive Zoning Ordinance of the City of Fort Worth, as amended, is hereby

amended to add a new Subsection 1.21 requiring that mixed use residential and
nonresidential developments be zoned "'PD' Planned Development District" and a new
Subsection 1.22 allowing multi-family residential development in certain designated
areas in or adjacent to designated employment centers, to read as follows
21 Apartments and/or multi-family dwellings, as part of a mixed use structure
or project, subject to compliance with parking requirements set out in Section
16A and provision of a site plan containing the requirements set out in paragraph
C and showing the density of units per acre, building height and separation, and
open space The Zoning Commission may not recommend to the City Council
that the site plan be waived The applicant shall also submit a service impact
analysis to address impact on sewer and water service, traffic, storm drainage,
nearby recreational amenities and residential land uses within '/a mile As part of
the City's early notification program for registered neighborhood associations,
notice of the proposed zoning change shall be sent to all registered
neighborhoods within ~/a mile of the property on which the Planned Development
is proposed.
22 Multi-family dwellings in designated areas in or adjacent to employment
centers An employment center is a distinct cluster of economic activities that
employ at least 30,000 people, have interrelated or complementary land uses
and can be identified 'by distinct geographic boundaries Employment centers
may include one large employer or a conglomeration of employers The
following areas are in or adjacent to employment centers and are eligible for
Planned Development zoning for multi-family dwellings
1 The area adjacent to the Central Business District/Downtown, as
described as "Tier 2" on Exhibit "2-H(1)" attached and incorporated by reference,
and
2 Areas in and adjacent to the Southside Medical District, as described on
Exhibit "2-H(2)" attached and incorporated by reference
Such multi-family dwellings shall be subject to compliance with parking
requirements set out in Section 16A and provision of a site plan containing the
requirements set out in paragraph C and showing the density of units per acre,
building height and separation, and open space The Zoning Commission may
not recommend to the City Council that the site plan be waived The applicant

SECTION 3
All recitals contained in Ordinance No 12628 are adopted and incorporated
herein by reference as though fully set out.
SECTION 4.
All provisions of the Comprehensive Zoning Ordinance not expressly repealed or
amended shall remain in full force and effect.
SECTION 5
' This ordinance shall be cumulative of all provisions of ordinances and of the
Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions
of this ordinance are in direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and such Code are
hereby repealed.
SECTION 6
It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if
any phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section

SECTION 7
Any person, firm or corporation who violates, disobeys, omits, neglects or
refuses to comply with or who resists the enforcement of any of the provisions of this
ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) for each
offense Each day that a violation is permitted to exist shall constitute a separate
offense
SECTION 8
All rights and remedies of the City of Fort Worth, Texas, are expressly saved as
to any and all violations of the provisions of Ordinance No 3011 or any other
ordinances affecting zoning which have accrued at the time of the effective date of this
ordinance, and, as to such accrued violations and all pending litigation, both civil and
criminal, whether pending in court or not, under such ordinances, same shall not be
affected by this ordinance but may be prosecuted until final disposition by the courts
SECTION 9.
The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish
the caption, penalty clause and effective date of this ordinance for two (2) days in the
official newspaper of the City of Fort Worth, Texas, as authorized by Section 52 013,
Texas Local Government Code
SECTION 10
This ordinance shall be in full force and effect from and after its passage and
" publication. as required by law, and it is so ordained
