AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED
CIVIL SERVICE POSITIONS AT EACH CLASSIFICATION TN TAE
POLICE DEPARTMENT; RECLASSIFYING TWO POLICE OFFICER
POSITIONS INTO CORPORAL/DETECTIVE POSITIONS BY CREATING
TWO ADDITIONAL CORPORAL/DETECTIVE POSITIONS AND DELETING
TWO POLICE OFFICER POSITIONS; PROVIDING A STATEMENT OF
PURPOSE AND INTENT FOR THE ADOPTION OF THIS ORDINANCE;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR ENGROSS-
MENT AND ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN
EFFECTIVE DATE.
BE IT HEREBY KNOWN:
WHEREAS, the Police Chief has requested the City Council to
readjust and thereafter specify the total number of authorized
civil service positions at each classification in the Police
Department for the remainder of the 1995-1996 Fiscal Year; and
WHEREAS, the City's most recent ordinance concerning the
authorized and budgeted positions for the Police Department
adjusted the Department's civil service staffing as follows:
Deputy Chiefs 5
Captains 13
Lieutenants 48
Sergeants 124
Corporal/Detectives 176
Police Officers 815
TOTAL 1,181
WHEREAS, the Police Chief now requests the Council to adjust
the authorized number of Police Department civil service positions
into conformity with the proposed changes as set forth immediately
below in order to effect efficient economy of the operations of the
Police Department; and
WHEREAS, pursuant to Chapter 143.021(x), Texas Local
Government Code, the City Council may prescribe and/or adjust the
authorized number of positions in each classification (rank) by
ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
That, effective immediately upon the formal adoption of this
ordinance, the following positions shall be the only civil service
positions authorized in the City of Fort Worth Police Department
for the remainder of the fiscal year 1995-1996 or until modified by
subsequent ordinance:
Deputy Chiefs 5
Captains 13
Lieutenants 48
Sergeants 124
Corporal/Detectives 178 **
Police Officers 813
TOTAL 1,181

SECTION 2.
The "Mayor and Council Communication" memorandum which is pre-
sented contemporaneously with this ordinance is hereby expressly
incorporated herein by reference for further clarification and
explanation of the purposes and intent of the Council in their
adoption of this ordinance. In addition, it is expressly stated
that this ordinance serves only to adjust the total number of
police officer positions and corporal/detective positions. This
ordinance shall not operate to increase or decrease the total

authorized number of civil service positions in the Police
Department.
SECTION 3.
This ordinance shall be cumulative of all provisions of
previous ordinances and of the Code of the City of Fort Worth,
Texas (1986), as amended, except where the provisions of this
ordinance are in direct conflict with the provisions of prior civil
service staffing ordinances for the Police Department and such
Code, in which event conflicting provisions of such ordinances .and
such Code provisions are hereby repealed.
SECTION 4.
Tt is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconsti-
tutional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 5.
The City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the
caption and effective date in the minutes of the City Council and
by filing the ordinance in the ordinance records of the City.

SECTION 6.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance specifying the authorized
positions in the Police Department, increasing by two the number of authorized
Corporal/Detective positions and decreasing the number of Police Officer positions by two
DISCUSSION
On June 22, 1993 the City Council approved M&C G-10214 which provided for assignment pay
to the seven Police Officers assigned to the Traffic Investigation Unit Since that time the Police
Officers assigned to the unit have received S 120 per month assignment pay due to the additional
responsibility investigating and preparing cases for prosecution for traffic related offenses These
officers are responsible for the investigation of all fatality accidents, DWI's involving fatalities,
hit and run accidents, auto-pedestrian accidents, reckless driving offenses, failure to stop and
render aid offenses and driving with license suspended offenses
As a result of legislative changes over the past few years, the job of the Traffic Investigator has
become more complex Hit and run accidents have become more involved Class B misdemeanor
offenses New laws covering intoxicated assault and intoxicated manslaughter have a definite
impact on the workload and activities of the unit With these new laws, the resulting case load
has required the personnel to become a criminal investigation unit which specializes in traffic-
related offenses Personnel assigned to the unit receive training to develop the expertise required
to factually and accurately reconstruct accident scenes to ascertain the cause as well as prepare
cases for prosecution
Due to the transition of this unit to a criminal investigative function, the department desires to
convert the police officer positions to corporal/detective positions as they become vacant
Currently, there are two police officer vacancies in the Traffic Investigation Unit that the
department wishes to fill with corporal/detectives.

Thus the resulting changes to the department`s authorized strength by decreasing two Police
Officer positions and adding two Corporal/Detective positions will be as follows

Since the Traffic Division Unit has been paying assignment pay to the Police Officers assigned
to investigate Traffic related offenses, the costs to add two Corporal/Detective positions will be
offset by the savings. accured from a reduction in the assignment pay
