AN ORDINANCE AMENDING SECTION 35-26(b) OF
CHAPTER 35, "WATER AND SEWERS", OF THE CODE OF
THE CITY OF FOR WORTH (1986), AS AMENDED, BY
REQUIRING ALL SWIMMING POOLS UTILIZING
DIAMOTACEOUS EARTH FILTERS TO BE EQUIPPED WITH
FILTRATION, PUMPING AND RECIRCULATION SYSTEMS
WHICH PROVIDE FOR RECYCLING OF FILTER BACKWASH
WATER; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS;
SECTION 1.
That Section 35-26(b) of Chapter 35, "Water and Sewers", of
the Code of the City of Fort Worth (1986 ) as amended, is hereby
amended to be and read as follows:
"SEC.35-26 NON-ESSENTIAL WATER USE RESTRICTIONS
(b) When referred to in this paragraph, "swimming pool"
shall mean any portable or permanent structure
containing or holding a body of water twenty-
four (24) inches or more in depth and
containing one thousand (1,000) gallons or
more of water and intended for recreational
purposes, including a wading pool. All
swimming pools utilizing diamoteceous earth
filters which are constructed 60 days after
the effective date of this ordinance shall be
equipped with filtration, pumping, and
recirculation systems which provide for
recycling of filter backwash water."
SECTION 2.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas (1986),
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and
such Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 4.
This ordinance shall be in full force and effect from and
after its passage and publication as required by law, and it is so
ordained.

SUBJECT WATER CONSERVATION ORDINANCE AMENDMENT
RECOMMENDATION
It is recommended that the City Council approve the attached ordinance amendment which
modifies the water conservation requirement to recycle swimming pool filter backwash water for
sand filter installations
DISCUSSION
As part of the City's water conservation efforts, the City Council approved an ordinance which
required all new swimming pools to be equipped with recirculation systems for recycling of filter
backwash water (M&C G-10669, 5/24!94) After working with this requirement for a brief
period, it has been determined that an effective recycle system for sand filters is not available
to the public The attached ordinance amendment would require backwash recycle systems for
filter installations utilizing diatomaceous earth-type filters only Swimming pools using sand
filters are permitted to discharge filter backwash water to the sanitary sewer
