HomeMy WebLinkAboutOrdinance 12486's ORDINANCE NO ~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WHOLESALE AND RETAIL WATER IMPACT FEES IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $7,500.00 AND WHOLESALE AND RETAIL WASTEWATER IMPACT FEES IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $7,500.00 FROM INCREASED REVENUE FOR THE PURPOSE OF FUNDING ADVERTISEMENT TO UPDATE WATER AND WASTEWATER IMPACT FEE REPORTS, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1995/96 and u1 the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $7,500.00 and Wholesale And Retail Wastewater Impact Fees in the Sewer Capital Projects Fund in the amount of $7,500.00 from increased revenue for the purpose of funding advertisement to update Water and Wastewater Impact Fee Reports. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 12074 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Authorize the City Manager to purchase advertisements in an amount not to exceed 515,000 00 to update the Water and Wastewater Impact Fee Reports DISCUSSION Chapter 395 of the Texas Local Government Code provides for local governments to enact and impose impact fees for capital improvements related to water and wastewater facilities. On June 6, 1990, the Fort Worth City Council adopted Ordinance No 10601, which was subsequently amended and replaced by Ordinance No 10871 on July 2, 1991, which implemented water and wastewater impact fees State law requires that the City update the Land Use Assumptions and Capital Improvements plan at least every three years, commencing from the date of the adoption of the Capital Improvements Plan On June 1, 1993, the City Council adopted Ordinance No 11328, which implemented the updated water and wastewater impact fees The Capital Improvements Plan was adopted on June 1, 1993 On February 13, 1996, the City Council approved an engineering agreement (M&C No C-15286? with Carter & Burgess, Inc to update water and wastewater impact fees State law further requires that the City advertise notice of the public hearing once a week for three consecutive weeks, the first notice to appear not less than thirty days and not more than sixty days before the date set for the hearing In addition, the State law specifically requires that notice of the public hearing be published in one or more newspapers of general circulation in each county in which the political subdivision lies, may not appear in the part of the paper in which legal notices and classified ads appear and, may not be smaller than one-quarter page in size Hence, it is requested that authorization be given to advertise the public hearing to update the Water and Wastewater Impact Fee Reports in the Fort Worth Star Telegram, Denton Record Chronicle, Burleson Star, Cleburne Times-Review, and I_a Vida Printed on Recyded Paper City of Fort Worth Texas Mayor and Council Communication DATE 04/16/96 REFER1i;NCE NUMBER **G-11452 LOG NAME 60ADS PAGL 2 of 2 SUBJECT APPROPRIATION ORDINANCE FOR ADVERTISEMENT TO UPDATE WATER.
