HomeMy WebLinkAboutOrdinance 12691OR®INANCE NO. ~ 9~ AN ORDINANCE CORRECTING ORDINANCE NO 12595 WHICH VACATED, ABANDONED, CLOSED AND EXTINGUISHED A STRIP OF RIGHT-OF-WAY ALONG THE WEST SIDE OF HARDING STREET, MOORE THORNTON AND COMPANY ADDITION; PROVIDING FOR THE REVERSION AND RELEASE OF THE CITY'S RIGHT, TITLE AND INTEREST IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Ordinance No 12595 was adopted on July 23, 1996 to vacate, abandon, close and extinguish fifteen (15) five (5) foot wide strips of right-of-way along First Street, Second Street, East Second Street, East Fourth Street, Elm Street, Crump Street, Harding Street and Nichols Street in connection with development of the Hillside Project; WHEREAS, Section 1, Subsection 13, of Ordinance No 12595 vacated right- of-way along the west side of Harding Street, described as a five (5) foot wide strip of right-of-way; WHEREAS, it is advisable to amend Ordinance No 12595 to correct the description of such right-of-way in order to Lot 1 at the intersection of Third Street and attached hereto, reflect that the right-of-way curves around Harding Street, as described on Exhibit "A" NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 THAT, Ordinance No 12595, Section 1, Subsection 13, is hereby amended to provide that the following street right-of-way specifically described in Exhibit "A", attached hereto and incorporated herein, be and the same is vacated, abandoned, permanently closed and extinguished A variable width strip of right-of-way along the west side of Harding Street fronting Lots 2 and 1, Block 25, Moore Thornton and Company Addition, and Lots 1, 1 A, and 2, Block 19, Moore Thornton and Company Addition, as described by metes and bounds description in Exhibit "B" SECTION 2. That all the City's right, title and interest in and to the land in and under the above described street and alley rights-of-way is released and shall revert to the property owner of the fee simple title to the land as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4.
