AN ORDINANCE VACATING, ABANDONING AND CLOSING AND
EXTINGUISHING A 20-FOOT WIDE SEWER AND 80-FOOT WIDE
TEMPORARY CONSTRUCTION EASEMENTS LOCATED IN THE CITYVIEW
ADDITION, OF THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the 20-foot wide sewer and 80-foot wide temporary
construction easements as created in Judgment recorded in Volume
78, Page 769 Tarrant County Court at Law Minute Book, located along
and through the common property line between Lots 3 and 4, Block 2,
of the Cityview Addition, as such lots are recorded in Volume 388-
217, Page 29-30, P.R.T.C.T. and as more fully described in Exhibit
A attached hereto be and the same are vacated, abandoned and
permanently closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated sewer
and temporary construction easements are hereby released and shall
revert to the adjacent owner as provided by law. The release in no
way releases any easements or portions of easements as created in
the plat, recorded in Volume 3.88-217, Page 29-30 P.R.T.C.T.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so
ordained.

Permanent Easement
A strip of ]and over, under and across a portion of a
tract of land out of the J. F Heath Survey, George
Shields Survey, J Burnett Survey, belonging to the
C. 0 Edwards Estate as recorded in Tarrant County
Deed Records, Tarrant County, Texas Said strip of
land to be ten (10') feet right and ten (10') feet
left and parallel to the center line described below
for the purpose of constructing, operating and main-
taining a twenty-four (24") inch and or eighteen (18")
inch sanitary sewer with the usual appurtenances and
necessary connections thereto
The center line of said sanitary sewer is described as
follows
BEGINNING at a point in the north survey line of the
J F Heath Survey, said point being west a distance
of 1518 feet from the southeast corner of the W.
Houston Survey, 1694 feet from the north east corner
of the J. F Heath Survey
THENCE south 17 degrees 14 minutes west a distance of
100 5 feet to the P.C of a curve to the left in a
southerly direction (Delta Angle 7 degrees 11 minutes
left, radius 398 7 feet, Tangents 25 0 feet, length
50 0 feet);
THENCE along said curve to the left in a southerly direc-
tion a distance of 50 0 feet to the P T of said
curve, end of twenty-four (24") inch, beginning of
eighteen (18") inch;
THENCE south 10 degrees 03 minutes west a distance of
403 feet to the P C of a curve to the left in a

SAVE AND EXCEPT Those portions of the sanitary sewer easement dedicated
by plat as shown on plat recorded in Volume 388-217, Page 29-30 of
the Plat Records of Tarrant County, Texas

It is further agreed. and understood that the City of
Fort Worth will be permitted the use of an additional
strip of land forty (40') feet right and forty (40') feet
left and parallel to the above described twenty (20')
foot wide permanent easement as an eighty (80') foot
wide construction easement for the purpose of construct-
ing said sanitary sewer
Upon completion of the construction of the said sanitary
sewer and its acceptance by the City Council of the City
of Fort Worth all rights conveyed with in the above eighty
(80') foot wide construction easement shall cease and all
operations, maintenance, and repairs shall be confined
to the above described twenty (20') foot wide permanent
easement

RECOMMENDATION[.
It is recommended that the- City Council adopt the attached ordinance vacating a 20-foot wide
sewer easement and an 80-foot wide temporary construction easement located along the
common property line between Lots 3 and 4, Block 2, Cityview Addition, as such lots are
recorded in Volume 388-217, Page 29-30, P R T C T Said easements were created in
Judgement recorded in Volume 78, Page 769, Tarrant County Court at Law Minute Book
DISCUSSION
Cityview Partners, L.P ,owner of all associated properties, has requested that the City vacate
the above described easements as recorded on the above referenced Judgement Reviewing City
departments and private utility companies have raised no objections to this request Adoption
of the attached ordinance will in no way release any easements or portion of easements as
established by the plat since the subject easements were created by a separate instrument The
subject sewer easement does not contain any underground sewer facilities
This request is located in COUNCIL DISTRICT NO 3
FISCAL INFORMATION/CERTIFICATION
The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the
interest of the City of Fort Worth in this request
