Ordinance No J b AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $90,000 00 FOR THE PURPOSE OF REPLACING AND RESTORING THE FIRE DAMAGED BOTANIC GARDENS FACILITIES; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1994-95 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially Funded Capital `•- Projects Fund in the amount of $90,000 00 for the purpose of replacing and restoring the fire damaged Botanic Gardens facilities SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction,' such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect SECTION 3 That this ordinance shall be cumulative of Ordinance No 11695 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained APPROVED recommended that the City Council 1 Authorize the transfer of 590,000 00 from the Insurance Fund to the Specially Funded Projects Fund for construction costs for the replacement of the Botanic Gardens potting shed and repairs to adjacent facilities damaged by fire on July 3, 1994, and 2 Adopt the attached appropriations ordnance increasing estimated receipts and appropriations by 590,000, in the Specially Funded Capital Projects Fund, from increased revenues DISCUSSION On July 3, 1994, the potting shed at the Botanic Gardens was destroyed by fire, and adjacent facilities sustained fire damage resulting from a pyrotechnic device landing on the facilities during the Independence Day celebrations In order to expedite replacement of the potting shed, ~t is recommended that funds necessary to construct the shed, as well as to fund certain administrative costs associated therewith, be advanced to a project account These funds will be reimbursed to the Insurance Fund upon successful subrogation The potting shed, listed on the 1 1 /30/93 property inventory/schedule of insured facilities as a greenhouse, was covered at 588,000, including contents Therefore, this is the maximum payable under the property insurance program 52,000 would be used toward the repairs to fire-damaged adjacent facilities On December 13, 1994, the City Council approved M&C C-14603 awarding Elbert R Spence, Architect, the architectural design contract for design of the new potting shed at the Botanic Gardens Funding for his services was, largely, from the Insurance Fund Bids are currently being solicited for the referenced construction and related repairs Upon receipt by the City of Fort Worth of documentation of the t"otal fire loss, subrogation will proceed to attempt recovery of the full amount from the responsible party A portion of the anticipated recovery, in an amount equal to advanced. funds from the Property and Casualfy Insurance Fund, will be retained therern Uninsured
