HomeMy WebLinkAboutOrdinance 12213Ordinance No pI C7c ~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $4,633 00 FOR THE PURPOSE OF FUNDING AN ENGINEERING AGREEMENT WITH BARYON-ASCHMAN ASSOCIATES, INC , FOR STREET RECONSTRUCTION, WATER, SANITARY SEWER REPLACEMENTS, AND STORM DRAIN IMPROVEMENTS ON THANNISCH AVENUE FORM WESLEYAN DRIVE TO VAUGHN BOULEVARD; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1995-96 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $4,633 00 for the purpose of funding an engineering agreement with Barton-Aschman Associates, Inc for street reconstruction, water, sanitary sewer replacement, and storm drain improvements on Thannisch Avenue form Wesleyan Drive to Vaughn Boulevard SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court. of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect SECTION 3 That this ordinance shall be cumulative of Ordinance No 12074 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect and be in full Council 1 Authorize the City Manager to transfer 517,871 00 from Water and Sewer Operating Fund to the Water Capital Projects Fund in the amount of 513,238 00 and Sewer Capital Projects Fund in the amount of 54,633 00, and 2 Adopt the attached appropriations ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of 513,238 00 and the Sewer Capital Projects Fund in the amount of 54,633 00 from increased revenue, and 3 Authorize the City Manager to execute an engineering agreement with Barton- Aschman Associates, Inc , for a fee not to exceed 539,070 00 to prepare plans and specifications for street, storm drain, water and sanitary sewer replacements in Thannisch Avenue from Wesleyan Drive to Vaughn Boulevard DISCUSSION The 1993 Capital Improvement Program included funds for the reconstruction of Thannisch Avenue from Wesleyan Drive to MLK Freeway The program also allowed for the reconstruction of Thannisch Avenue from Vaughn Blvd to Campbell Avenue However, the section of Thannisch Avenue between MLK Freeway and Vaughn Drive was inadvertently omitted and will be included as part of this project The existing pavement is substandard and requires high maintenance The existing drainage facilities are inadequate and the Water Department has determined that water and sanitary sewer lines in these streets are in need of replacement prior to street reconstruction Barton-Aschman Associates, Inc proposes to perform the design work for this project for a fee not to exceed 539,070 00 based on established hourly rates DISTRICT 8 (Mapsco Page 78T) In addition to the contract amount, 5688 00 is required by the Department of Engineering for water and sanitary sewer plan and contract document review , FISCAL INFORMATION/CERTIFICATION The Director of Fiscal Services certifies that upon approval and completion of recommendation 1, and the adoption of the attached appropriations ordinance, funds will be
