ORDINANCE NO. ~a(~~'y`- AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISHING FIFTEEN (15) FIVE (5') FOOT WIDE STRIP RIGHTS-OF- WAY ALONG FIRST STREET, SECOND STREET, EAST SECOND STREET, EAST FOURTH STREET, ELM STREET, CRUMP STREET, HARDING STREET AND NICHOLS STREET LOCATED WITHIN THE ORIGINAL TOWN ADDITION, THE GILLON AND CRUMP SUBDIVISION, THE MOORE THORNTON & COMPANY ADDITION, THE MOORE THORNTON STRIPS AND THE NBC WAREHOUSE TRACT, A TRIANGULAR PORTION OF ELM STREET LOCATED WITHIN THE GILLON AND CRUMP SUBDIVISION, A TRIANGULAR PORTION OF THE ORIGINAL RIGHT-OF-WAY OF THIRD STREET LOCATED WITHIN THE MOORE THORNTON AND COMPANY ADDITION, AND AN ALLEY RIGHT- OF-WAY LOCATED WITHIN BLOCK 1 OF THE GILLON AND CRUMP SUBDIVISION OF THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR THE REVERSION AND RELEASE OF THE CITY'S RIGHT, TITLE AND INTEREST IN SAID LAND, PROVIDING FOR CONDITIONS PRECEDENT TO THE OCCURRENCE OF SAME, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 THAT subject to the occurrence of the conditions prescribed in Section 3 hereof, the following street and alley rights-of-way specifically described in Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned, permanently closed and extinguished 1) 5-Foot Wide Strip of Right-Of-Way Located along the South Side Of First Street Fronting Lots 22 Through 26 and Lot 34A, Block 30, Original Town of Fort Worth (Approximately 430 Linear Feet), 2.) 5-Foot Wide Strip of Right-Of-Way along the North Side of Second Street Fronting Lots 27 Through 32 and Lot 34B, Block 30, Original Town of Fort Worth (Approximately 360 Linear Feet), 3) 5-Foot Wide Strip of Right-Of-Way along the South Side of East Second Street Fronting Lot 3, Block 2, Gillon and Crump Subdivision (Approximately 50 Linear Feet), 4) 5-Foot Wide Strip of Right-Of-Way along the South Side of East and Company Addition (Approximately 345 Linear Feet), 16) A Triangular Portion of Elm Street, North of 3rd Street and West of Lot 8, Block 1, Gillon and Crump Subdivision, 17) A Triangular Portion of the Original Right-Of-Way of Third Street, South of Lots 2A, 4A, 4B, Block 20, Moore Thornton and Company Addition, and West of Nichols Street; 18) Entire Alley Right-Of-Way Located in Block 1, Gillon and Crump Subdivision SECTION 2. That subject to the occurrence of the conditions prescribed in Section 3 hereof, all the City's right, title and interest in and to the land in and under the above described street and alley rights-of--way is released and shall revert to the property owner of the fee simple title to the land as provided by law SECTION 3 That the vacation, abandonment, closure and extinguishment of the above described portions of the street and alley rights-of-way, and the release and reversion of the City's right, title, and interest in and to the land therein, shall be subject to and conditioned upon (i) the approval of the final plat by the City Plan Commission, and (ii) the filing of said final plat in the Tarrant County Plat Records on or before January 30, 1996 In the event such final plat is approved and filed for record in the Tarrant County Plat Records within the prescribed time, then a copy of said final plat shall be attached as Exhibit "B" to this ordinance, as same is filed in the office of the City Secretary of the City of Fort Worth, and the attachment of said final plat as Exhibit "B" shall constitute conclusive evidence of the occurrence of such conditions. In the event said plat is not approved by the City and filed in the Tarrant County Plat Records on or before January 30, 1996, then this ordinance shall become null and void, the same as if it had never been adopted; and the vacation, abandonment, closure and extinguishment of the street and alley rights-of-way, and the release and reversion of the right, title and interest in and to the land therein shall not take effect. SECTION 4 That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 5 That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained.
