Ordinance No
AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE ENVIRONMENTAL MANAGEMENT FUND IN THE AMOUNT OF $97,950 00 FOR THE
PURPOSE OF FUNDING AN INTER-LOCAL AGREEMENT WITH VARIOUS CITIES FOR
PARTICIPATION IN A REGIONAL HOUSEHOLD HAZARDOUS WASTE COLLECTION
EVENT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments
for the Fiscal Year 1995-96 and in the Budget of the City Manager, there
shall also be increased estimated receipts and appropriations in the
Environmental Management Fund in the amount of $97,950 00 for the purpose of
funding an inter-local agreement with various cities for participation in a
regional household hazardous waste collection event
SECTION 2

Should any portion, section or part of a section of this ordinance be declared
invalid, inoperative or void for any reason by a court of competent jurisdiction,
such decision, opinion or judgement shall in no way impair the remaining portions,
sections, or parts of sections of this ordinance, which said remaining provisions
shall be and remain in full force and effect
SECTION 3
That this ordinance shall be cumulative of Ordinance No 12074 and all other
ordinances and appropriations amending the same except in those instances where
the provisions of this ordinance are in direct conflict with such other ordinances
and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed
SECTION 4
This ordinance shall take effect and be in full force and effect and after the
date of its passage, and it is so ordained

SUBJECT INTER-LOCAL AGREEMENT WITH VARIOUS CITIES FOR PARTICIPATION IN A
REGIONAL HOUSEHOLD HAZARDOUS WASTE COLLECTION EVENT
RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to enter into the attached inter-local agreement and its
accompanying resolution with the cities of Bedford, Colleyville, Grapevine, Haltom City,
Hurst, Kennedale, North Richland Hills, Richland Hills and River Oaks providing for their
participation in and payment of proportionate non-grant funded costs for the October
household hazardous waste collection event in the amount of 597,950 00, and
2 Adopt the attached appropriations ordinance increasing estimated receipts and
appropriations in the Environmental Management Fund by 597,950 00 from increased..
revenues
DISCUSSION
Due to new restrictions placed on Hazardous Waste grant funding, the City of Fort Worth was
not able to apply for this year's grant !n turn, Tarrant County applied for and was the recipient
of a 5100,000 grant from the Texas Natural Resource Conservation Commission to assist in
conducting a regional household hazardous waste collection event during 1995 This event is
scheduled for October 28, 1995
The County has elected to sub-contract with the City of Fort Worth for the oversight and
coordination of this regional. event As last year, other area governments will have the
opportunity to join in this collection event with each paying for its share of the estimated non-
grant funded costs In order to participate in the event, each entity will be required to enter into
an inter-local agreement with the City of Fort Worth This agreement outlines the responsibilities
of each party, establishes each party's maximum cost for participation in the event, and requires
each party to indemnify and hold harmless all other participating entities The resolution
accompanying the inter-local agreement is required to legalize the mutual indemnification
provisions of the agreement
The City of Fort Worth is responsible for overall coordination of the event, including contracting
with a hazardous waste disposal company to set up collection facilities at two sites In addition
to committing funds, the inter-local agreement requires each of the other cities to designate a
representative to serve on the event planning committee and solicit volunteers to work at the
event In addition, the City of North Richland Hills has also agreed to provide traffic control and
solid waste disposal services at the satellite collection site on the Tarrant County Junior College

Total 597,950 00
As part of awarding the contract to the hazardous waste disposal firm, the City of Fort Worth
is required to commit 51 18,425 00 towards its share of the event's cost Each city's
contribution is based upon an estimated number of households that will participate in the event
and a projected cost per household Any local funds remaining at the conclusion of the event
will be refunded to all cities on a pro-rata basis
FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that upon approval of the attached appropriations
ordinance, funds required for these expenditures will be available in the current operating budget
of the Environmental Management Fund
