HomeMy WebLinkAboutOrdinance 11922t;i ORDINANCE NO AN ORDINANCE AMENDING CHAPTER 14, "GARBAGE", BY AMENDING SECTION 14-34(a), AMENDING CHAPTER 35, "WATER AND SEWERS", BY AMENDING SECTION 35-61(a)(3), AND AMENDING SECTION 14-26 OF CHAPTER 14 MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES AND PROVISIONS OF THE CODE OF THE CITY OF FORT WORTH IN CONFLICT HEREWITH, PROVIDING A SAVING CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AND EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That subsection (a) of Section 14-34 of Chapter 14 of the Code of the City of Fort Worth (1986), as amended, is hereby amended to be and read as follows. (a) A separate fee of fifty (50) cents per month shall be charged to persons within the city for solid waste disposal services authorized by V T C.A., Health and Safety Code, section 364 034 Such fee shall be assessed to each customer per service address and included on the monthly water bill. Such fee shall be in addition to any fees for other services regulated by this article and shall be shown as "environmental protection fee" SECTION 2. That subsection (3) of Section 35-56 (a) of Chapter 35 of the Code of the Crty of Fort Worth (1986), as amended, is hereby amended to be and read as follows. (3) Letter of credit drawn on a state or federally chartered lending institution located in Tarrant County, Texas, provided however, that m the event the letter of credit is not renewed at least fifteen (15) days prior to the date of expiration, the letter of credit may be drawn upon and the funds so received shall become a cash deposit. SECTION 3 That Section 14-26 of Chapter 14, "Garbage" of the Code of the Crty of Fort Worth (1986), as amended, is hereby amended to read as follows. -i, The fees for the service regulated by this article shall be included on the monthly water bills, and any person who shall fail or refuse to pay such fees within ten (10) days from the date of the second billing, shall be subject to having all utility services provided by the City suspended until payment is made. The owner, occupant, tenant or lessee using or occupying any unit of any building, house or structure shall be responsible for the payment of the garbage collection and trash removal fees incurred therefore." SECTION 4 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such. ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6 This ordinance shall take effect and be in full force and effect from and after passage, and it is so ordained.
