AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER
TO EXECUTE A CONVEYANCE OF 8.646 ACRES, MORE OR LESS, OF
UNDEVELOPED CITY PARKLAND TO THE TRINITY VALLEY SCHOOL IN
EXCHANGE FOR 9.01 ACRES, MORE OR LESS, OF LAND ADJOINING
OAKMONT LINEAR PARK TO BE USED FOR PARK PURPOSES; MAKING
THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES; PROVIDING
A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Fort Worth acquired in 1979 a 27 acre site
known as Oakmont Linear Park through the park dedication
policy of the City's subdivision ordinance; and
WHEREAS, this park site, located between Dutch Branch Road and
Bryant Irvin Road, has been held in reserve awaiting
residential development to occur; and
WHEREAS, on March 6, 1995, the Parks and Community Services Board
(the Board) recommended that the City Council adopt an
ordinance calling for the authorization to sell or
exchange an 8.646 acre parcel of Oakmont Linear Park be
presented to voters in a municipal election in accordance
with Section 253.001(b) of the Local Government Code; and
WHEREAS, the Board additionally recommended that the competitive
bid process for sale or exchange of the parkland be
structured so as to facilitate the acquisition of land
suitable for park purposes to serve the area within the
original Oakmont Concept Plan; and
WHEREAS, on March 15, 1995, the City Council adopted an ordinance
ordering an election to be held on Saturday, May 6, 1995,
for the purpose of submitting to the qualified voters of
Fort Worth a proposition authorizing the sale or exchange
of the 8.646 acre tract; and
WHEREAS, on April 14 and 15, 1995, the City advertised the sale or
exchange of the subject property, appraised at $205,000,
in accordance with Section 272.001 of the Local
Government Code; and
WHEREAS, the only bid submitted was that of the Trinity Valley
School, which offered a 9.010 acre parcel of land
adjoining the Oakmont Linear Park, and appraised at
$260,000, in exchange for the subject property; and
WHEREAS, on May 6, 1995, a City election was held which included
the proposition authorizing the sale or exchange of the
subject property; and

WHEREAS, on May 9, 1995, the City Council canvassed the returns
and declared the favorable passage of the proposition;
and
WHEREAS, the Parks and Community Services Department has reviewed
the submitted bid of Trinity Valley School and determined
that the exchange property is suitable for parkland and
recommends acceptance of the bid; and
WHEREAS, Section 253.001(c) of the Local Government Code requires
the adoption of an ordinance directing the City Manager
to execute the conveyance of park property;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
That the City Manager is hereby authorized and directed to
execute a conveyance, after approval as to form by the City
Attorney, of property consisting of 8.646 acres, more or less, as
more specifically described in Exhibit A attached hereto and
incorporated herein, to the Trinity Valley School.
SECTION 2.
That the City Manager is hereby authorized and directed to
accept and record a conveyance to the City from the Trinity Valley
School, in exchange for the property conveyed pursuant to Section
1 of this ordinance, of property consisting of 9.010 acres, more or
less, as more specifically described in Exhibit B attached hereto
and incorporated herein.
SECTION 3.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas (1986),
as amended, except where the provisions of this ordinance are in

direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and
such Code are hereby repealed.
SECTION 4.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 5.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

RECOMMENDATION
It is recommended that the City Council
1 Accept the bid of 9 0'10 acres of property at an appraised value of 5260,000 from the
Trinity Valley School, and
2 Adopt the attached ordinance directing the City Manager to convey 8 646 acres of
parkland a portion of Oakmont Linear Park to the Trinity Valley School, and
3 Approve the dedication of the 9 010 acres received from the Trinity Valley School as
parkland
DISCUSSION
The Parks and Community Services Department was approached by representatives ofthe Trinity
Valley School on June 6, 1994 regarding the possibility of the School's acquisition or exchange
of 8 646 acres of undeveloped City parkland adjacent to their proposed campus The subject
park parcel is part of a 27 acre site known as Oakmont Linear Park acquired by the City in 1979
through the Park Dedication Policy of the City's Subdivision Ordinance Located between Dutch
Branch Road and Bryant Irvin Road, this park site has been held in reserve awaiting residential
development to occur
In accordance with Sections 253 001 and 272 001 of the Local Government Code, a City may
dispose of public parkland only after an election approving the conveyance and advertisement
of sale or exchange by competitive bids
On March 6, 1995, a special meeting of the Parks and Community Services Advisory Board was
held to consider recommendation to City Council to place this item on the May 6, 1995 general
election ballot A motion to concur with staff's recommendation to the City Council that it adopt
an ordinance calling for the authorization to sell or exchange a portion of Oakmont Linear Park
to be presented to the voters in a municipal election was approved The Board additionally
recommended that the competitive bid process for sale and/or exchange of the parkland be
structured so as to facilitate the acquisition of land suitable for park purposes to serve the area
within the original Oakmont Concept Plan

On March 7„ 1995, an Informal Report (No 7894) was presented to the City Council This
report outlined'~the necessary steps to place this proposed sale and/or exchange of parkland on
the May 6, 1995 election ballot
On March 15, 1995 (OCS-697), the City Council adopted an Ordinance ordering an election to
be held on Saturday, May 6, 1995, for the purpose of submitting to the qualified voters of the
City of Fort Worth a proposition authorizing the sale or exchange of an 8 646 acre tract of public
parkland located in the John F Heath Survey, Abstract No 641, Tarrant County, Texas

On March 24, 1,995, a certified appraisal for the City owned 8 646 acre tract was received This
real estate appraisal commissioned by the City estimated the market value in fee simple title for
the parkland to be 5205,000 This amount established the minimum bid for the purchase or
exchange property bidding process
In accordance with Section 272 001 of the Local Government Code, the City of Fort Worth
advertised the sale or exchange of the subject property on April 14 and 15, 1995 in the Fort
Worth Star-Telegram On April 27, 1995, bids were received and only one bidder responded
The bid from the Trinity Valley School Department Only one bid was submitted The bid from
the Trinity Valley School identified 9 010 acres of land which adjoined the Oakmont Linear Park
site and demonstrated through a certified appraisal its fair market value to be 5260,000
On May 6, 1995, a City election was held which included the proposition authorizing the sale
or exchange of the 8 646 acre park site
On May 9, 1995, the City Council canvassed the returns and declared the favorable passage of
the City elections held on May 6, 1995 for the sale or exchange of parkland A total of 10,774
ballots were cast with 7,769 in favor of the parkland sale or exchange This represented a
72 1 % approval
The Parks and Community Services Department has reviewed the bid of the Trinity Valley School
and finds the exchange property as suitable for parkland Based upon its size, fair market value
and potential use as parkland, staff recommends the acceptance of the bid The attached map
indicates the boundaries of the entire park site, the private school property, that portion of
parkland proposed to be exchanged and the exchanged property
The subject exchange property and Oakmont Linear Park is located in Council District No 3
FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that there will be no City funds required for this action
