HomeMy WebLinkAboutOrdinance 11937_ ._ ~ Ordinance No AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $63,385 00 FOR THE PURPOSE OF FUNDING WITH THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION FOR PERFORMING CERTAIN AIR POLLUTION CONTROL ACTIVITIES DURING FY 94-95; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CI`!'Y OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1994-95 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $63,385 00 for the purpose of funding with the Texas Natural Resource Conservation Commission for performing certain air pollution control activities during FY 94-95 SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect SECTION 3 That this ordinance shall be cumulative of Ordinance No 11645 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage,^and it is so ordained APPROVED AS TO FORM AND LEGALITY Att ey =~ ~~~~ Date ` / ~~ "`-9 ~ ~~ ~--- Adopted ~` ~~ Effective City of Fort Worth, Texas l~ Mayor and Council Communication DATE REFERENCE NU[~ER LOG NAME PAGE 04/27/95 **C-14785 52AIR 1 of 2 svsJECT CONTRACT WITH THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION FOR PERFORMING CERTAIN AIR POLLUTION CONTROL ACTIVITIES DURING FY 94- 95 RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to execute an agreement with the Texas Natural Resource Conservation Commission (TNRCC) in the minimum amount of 563,385 00 for performance of certain air pollution control activities by the City during the period September 1, 1994 through August 31, 1995, and 2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by 563,385 00 from increased revenues DISCUSSION Since FY 1991-92, the City has entered into an annual contract with the Texas Natural Resource Conservation Commission (formerly the Texas Air Control Board) authorizing the City to provide certain air pollution control services within Fort Worth The services provided include Complaint Investigation, New Source Review and Comment, Annual Inspections at certain Non-Major VOC Sources, and Used Car Emission Device Inspections Beginning in FY 93-94, the contract also included inspection of Stage II Vapor Recovery systems at area gas stations In previous years, this contract has also included investigation and enforcement of asbestos regulations related to the demolition or renovation of commercial structures Beginning in FY 94- 95, the City has elected to drop out of this function and allow the Texas Department of Health to assume responsibility for these inspections Under the proposed contract, the TNRCC will pay the City 563,385 00, which is approximately a 528,500 00 increase over FY 93-94 Much of this increased funding is the result of including a full year of Stage II Vapor Recovery inspections The funds received under this contract will offset budgeted General Fund expenditures within the Air Quality Division of the Department of Environmental Management and will serve as part of the City's required match fora 5100,000 00 EPA Section 105 Air Quality Grant previously approved by the City Council Printed on recyded paper City of Fort Worth, Texas Mayor and' Council C c-mmunicatioyc DATE 04/27/95 REFERENCE NUMBER **C-14785 LOG NAME 52AIR PAGE 2 of 2 SUBJECT CONTRACT WITH THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION FOR PERFORMING CERTAIN AIR POLLUTION CONTROL ACTIVITIES DURING FY 94- 95 FISCAL INFORMATION/CERTIFICATION The Director of Fiscal Services certifies that upon approval and execution of the contract with TNRCC, funds will be available as appropriated in the Grants Fund MG a Submitted for City Manager's FUND ACCOUNT CENTER AMOUNT CITY SECRETARY Office by: (to) GR76 451315 052214236030 $63,385 00 p v~ Mike Groomer 6140 ~~ Y ~~ Originating Department Head: a~ ~7 ~ss5 Mike Groomer 6140 (gym) [GCc.~~ LQ.~.~/A'ti6~ For Additional Information City 8eorsfaiy 01~ ~l@ Citp of Fort WOt~, ~~§ Contact: Mike Groomer 6140 Printed on recycled paper
