HomeMy WebLinkAboutOrdinance 12037ORDINANCE NO /oCy~~ AS AMENDED AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN AN AMOUNT UP TO $150,000 00 FROM INCREASED REVENUE FOR THE PURPOSE OF FUNDING STUDIES RELATED TO DISCRIMINATION IN MORTGAGE LENDING; PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1994-95 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in an amount up to $150,000.00 from increased revenue for the purpose of funding studies relaed to discrimination in mortgage lending. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 11645 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. Date 7 1 ~- ~~ Adopted Effective City of Fort Worth, Texas 1~Iayor and Council Communication 07/18/95 ~ **G-11159 ~ 07GRANT ~ 1 of 2 3UBJ8CT GRANT APPLICATION TO U S DEPT OF HOUSING AND URBAN DEVELOPMENT FOR STUDIES RELATED TO DISCRIMINATION 1N MORTGAGE LENDING AND INSURANCE REDLINING RECOMMENDATION It is recommended that the City Council authorize the City Manager to Submit a grant application to the U S Department of Housing and Urban Development (HUD) for funding in the amount of up to 5150,000 00 for the performance of Fair Housing-related studies under HUD's Fair Housing Initiatives Program (FHIP) The activities proposed under the grant are (1) the performance of a testing program in which the practices of major mortgage tending institutions are examined with respect to applicable housing discrimination laws, and (2) the performance of a study of the practices of providers of homeowners insurance with respect to applicable housing discrimination laws, and 2 Adopt the attached appropriations ordinance increasing estimated receipts and appropriations in the Grants Fund up to 5150,000 00 from increased revenue, contingent upon receipt and deposit of funds, and 3 Authorize the Accounting Division of the Fiscal Services Department, subject to approval by the U S Dept of Housing and Urban Development and the City Manager's acceptance of the grant, to establish the Fair Housing Initiatives Program project accounts in the City of Fort Worth's financial accounting system DISCUSSION Each year the U S Dept of Housing and Urban Development (HUD) solicits proposals for Fair Housing activities under its Fair Housing Initiatives Program (FHIP) The FHIP program is designed to provide funding of special projects in the area of Fair Housing State and local Fair Housing enforcement agencies, such as the Fort Worth Human Relations Commission (FWHRC), are eligible to apply for the funding of such projects Of late, HUD has made the addressing of discrimination in mortgage lending and insurance "redlining" its first priority The FWHRC will propose the conducting of a testing program in which lthe pre-application practices of local mortgage lending institutions are tested for compliance with Fair Housing laws The FWHRC will also propose the conducting of a statistical study of patterns of sales of homeowner's insurance within Fort Worth Studies of this kind have never been performed in Fort Worth This project will apply equally to all council districts City of Fort Worth, Texas Mayor and Council Communication DATE 07/18/95 REFERENCE NUbIBBR *'kG-11159 LOG NAMB 07GRANT PAGE 2 of 2 StTBJECT GRANT APPLICATION TO U S DEPT OF HOUSING AND URBAN DEVELOPMENT FOR STUDIES RELATED TO DISCRIMINATION IN MORTGAGE LENDING AND INSURANCE REDLINING FISCAL INFORMATION/CERTIFICATION The Director of Fiscal Services certifies that upon execution of the grant agreement with the U S Department of Housing and Urban Development and the adoption of the attached appropriation ordinance, funds will be available in the current budget of the Grants Fund The Director of Fiscal Services certifies that the Human Relations Commission will. be responsible for the collection of the funds due the City under this agreement CB a Submitted for City Manager's FUND ACCOUNT CENTER AMOUNT CITY SECRETARY Office by: (to) Ramon Guajardo 6140 APP~O~f ~p Originating Department Head: (~ ~~~~ ~~C~~ Michael D Ivey 7525 (from) ~~'~ ~~ For Additional Information ~~ ~caa,o,~ ~~ Contact: City ffiearataarg of the City of Fbgt f~ortty Texas Michael D Ivey 7525
