HomeMy WebLinkAboutOrdinance 12038ORDINANCE NO.. / °Z D~0 AN ORDINANCE AMENDING CITY OF FORT WORTH ORDINANCE NO. 9663, BY FINDING THAT THE PUBLIC CONVENIENCE AND NECESSITY NO LONGER REQUIRE THE OPERATION BY ALL AMERICAN CAB COMPANY INC., OF 130 TAXICABS ON AND OVER THE PUBLIC STREETS, ALLEYS AND THOROUGHFARES OF THE CITY, AND BY REDUCING THE NUMBER OF TAXICABS AUTHORIZED TO OPERATE UNDER CITY OF FORT WORTH ORDINANCE NO. 9663 FROM 130 TO 50; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES, PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR WRITTEN ACCEPTANCE BY ALL AMERICAN CAB COMPANY, INC , AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on June 24, 1986, the City Council, by M&C G-6715, adopted City of Fort Worth Ordinance No. 9663, granting unto American Cab Company the authority to operate 130 taxicabs on and over the City streets for a ten year period expiring on June 26, 1996; and WHEREAS, on April 11, 1995, the City Council, by M&C G-11045, approved the transfer of such authority from American Cab Company to All American Cab Company, Inc..; and WHEREAS, American Cab Company, Inc., has determined that because of the economic conditions in the City of Fort Worth and Tarrant County over the past few years, the public convenience and necessity do not require the number of taxicabs currently authorized under City of Fort Worth Ordinance No. 9663; and WHEREAS, All American Cab Company, Inc has requested that the City Council of the City of Fort Worth adopt an ordinance reducing the number of taxicabs authorized under City Ordinance No. 9663, from 130 to 50, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1. That the Fort Worth City Council finds that the public convenience and necessity no longer require the operation by All American Cab Company, Inc of 130 taxicabs on and over the public streets, alleys and thoroughfares of the City, as currently authorized under City of Fort Worth Ordinance No 9663, and that Ordinance No 9663, is hereby amended to incorporate and reflect such findings. SECTION 2 That the Fort Worth City Council further finds that the public convenience and necessity require that the number of taxicabs authorized under City of Fort Worth Ordinance No. 9663, be reduced from 130 taxicabs to 50 taxicabs, and that Ordinance No. 9663, is hereby amended to incorporate and reflect such findings.. SECTION 3. That City of Fort Worth Ordinance No. 9663, is further amended to provide that the number of taxicabs authorized under City of Fort Worth Ordinance No. 9663, is hereby reduced from 130 to 50; and that following said amendment, All American Cab Company, Inc., shall be granted the privilege to operate 50 taxicabs on and over the streets, alleys, and public thoroughfares of the City of Fort Worth, Texas, in its business of providing public taxicab service within the City's municipal limits, for the period beginning with the adoption of this ordinance by the City Council and acceptance thereof by All American Cab Company, Inc., and expiring June 26, 1996. SECTION 4. That this ordinance shall repeal every prior ordinance in conflict herewith only insofar as any portion of such ordinance shall be in conflict, and as to all other ordinances not in direct conflict herewith, such ordinances shall remain in full force and effect, and this ordinance shall be and is hereby made cumulative. SECTION 5. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of Ordinance Na. 9663, or any amendments thereto, which have accrued at the time of the effective date of this ordinance; and as to such accrued violations, the Court shall have all of the powers that existed prior to the effective date of this ordinance SECTION 6. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such unconstitutional phrase, clause, sentence, paragraph or section 2 SECTION 7. That within ten (10} days after the adoption of this ordinance, All American Cab Company, Inc shall file with the City Secretary written acceptance of the terms and provisions hereof. SECTION 8.
