HomeMy WebLinkAboutOrdinance 11944Ordinance No AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STREET IMPROVEMENTS FUND IN THE AMOUNT OF $1,509,000 00 FOR THE PURPOSE OF FUNDING CONGESTION MITIGATION AND AIR QUALITY IMPROVEMENT AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR INTERSECTION IMPROVEMENTS ON NORTH BEACH STREET AT IH-820 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1994-95 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Street Improvements Fund in the amount of $1,504,000 00 for the purpose of funding congestion mitigation and air quality improvement agreement with the Texas Department of Transportation for intersection improvements on North Beach Street at IH-820 SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect SECTION 3 That this ordinance shall be cumulative of Ordinance No 11645 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained APPROVED AS TO FORM AND LEGALITY ~c'y~'1~ !`~ n._ L City Attorney /`1~JT' S- ~ o - ~ ~ Date ~S Adopted Effective City of Fort Worth, Texas Mayor and Council ~;cmzmunication DATE REFERENCE LOG NAME PAGE 05/09/95 NuMSER **C 14800 20BEAC 1 of 2 SUBJECT CONGESTION MITIGATION AND AIR QUALITY IMPROVEMENT PROJECT AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR INTERSECTION IMPROVEMENTS ON NORTH BEACH STREET AT IH-820 (PROJECT NO 111-021209) RECOMMENDATION It is recommended the City Council 1 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Assessment Fund by $1,504,000 from increased revenues, and 2 Authorize the transfer of $1,504,000 from the Special Assessment Fund to the Street Improvements Fund, and 3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Street Improvements Fund by 51,504,000 from increased revenues for the purpose of congestion mitigation and air quality improvements with the Texas Department of Transportation (TxDOT), and 4 Authorize the City Manager to execute a Congestion Mitigation and Air Quality Improvement Agreement with the TxDOT for intersection improvements on North Beach Street at IH-820 at an estimated cost of 51,504,000 DISCUSSION The Intermodal Transportation Efficiency Act of 1991, (ISTEA), established a congestion mitigation and air quality improvement program (CMAQ) to contribute to the attainment of a natural ambient air quality standard On November 30, 1994, the Texas Transportation Commission passed Minute Order 104667 which authorized the intersection improvement project on North Beach Street at IH-820 through the State Transportation Improvement Program The Texas Department of Transportation (TxDOT) has prepared an agreement which details the responsibilities of both the City of Fort Worth and TxDOT in the development of this project The City is responsible for the design of the intersection improvements, securing any needed rights- of-way, and adjusting or relocating utilities TxDOT will advertise, award and inspect construction of the project The project is estimated to cost 53,200 000 The State and Federal share will not exceed fifty- three percent (53%) of the actual cost of the project Costs in excess of the State and Federal share will be borne by the City of Fort Worth The City's share of cost is currently estimated to be 51,504,000 Upon execution of the agreement, the City must remit payment in the amount of 515,040 to TxDOT for their review of engineering documentation and other incidental costs Printed on recyded paper City of Fort Wort)z, Texas Mayor and' Council Communication DATE REFERENCE NUMBER **C-14SOO LOG NAME PAGE 05/09/95 20BEAC 2 of 2 SUBJECT CONGESTION MITIGATION AND AIR QUALITY IMPROVEMENT PROJECT AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR INTERSECTION IMPROVEMENTS ON NORTH BEACH STREET AT IH-820 (PROJECT NO 1 11-021209) Approximately sixty (60) days prior to TxDOT's awarding of the construction contract, the City will be required to fund the balance of the City's share of the project cost North Beach Street north of IH-82G is a divided major arterial street TxDOT plans to let a construction contract in June, 1995 to build the east half of North Beach Street from IH-820 south to Long Avenue This new half in conjunction with the existing west half of North Beach Street will result in a divided major arterial street from IH-820 to Long Avenue The section of North Beach Street under IH-820 however is undivided and only four lanes in width Currently, this intersection is heavily congested, especially in AM and PM peak traffic hours A traffic signal has recently been installed to assist in safely moving traffic through this intersection Widening of North Beach Street under IH-820 to a six lane section with turning lanes is badly needed The surrounding area ~s rapidly developing and the problem will continue to worsen if North Beach Street is not widened and improved The project will involve extensive work on IH-820 to accommodate the widened North Beach Street bridges This project will substantially reduce traffic congestion atthis intersection, reduce delay time and increase air quality FISCAL INFORMATION/CERTIFICATION The Director of Fiscal Services certifies that upon the approval of the above recommendations and adoption of the attached appropriations ordinances, funds required will be available in the Street Improvement Fund The cash balance in the Special Assessment Fund after this transfer will be 54,507,964 MG a ubm.tted or .ty Managers FUND A COUNT CENTER AMOUNT CITY RET Y Office by: (to) 1) GS 4 441 2 020940 120 1, 0 0 OVED~~ Mike Groomer 6140 ) GS 7 0 0940212 90 1, ,oo APPR rigmatmg Department Head: 2) GC13 472094 020130212090 1,504,000.0 ~~y COUN C IL 3) GC13 541200 020130212090 1,504,000.0 Hugo A.
