AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE SPECIAL ASSESSMENT FUND IN THE AMOiJNT OF $920,000 00 FOR THE
PURPOSE OF FUNDING CONGESTION MITIGATION AND AIR QUALITY IMPROVEMENT
AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR R GRADE
SEPARATION ON NORTH BEACH AT THE RAILTRAN CROSSING
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for
the Fiscal Year 1994-95 and in the Budget of the City Manager, there shall also be
increased estimated receipts and appropriations in the Special Assessment Fund in
the amount of $920,000 00 for the purpose of funding congestion mitigation and air
quality improvement agreement with the Texas Department of Transportation for a
grade separation on North Beach at the Railtran crossing
SECTION 2
Should any portion, section or part of a section of this ordinance be declared
invalid, inoperative or void for any reason by a court of competent jurisdiction,
such decision, opinion or judgement shall in no way impair the remaining portions,
sections, or parts of sections of this ordinance, which said remaining provisions
shall be and remain in full force and effect
SECTION 3
That this ordinance shall be cumulative of Ordinance No 11645 and all other
ordinances and appropriations amending the same except in those instances where
the provisions of this ordinance are in direct conflict with such other ordinances
and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed
SECTION 4
This ordinance shall take effect and be in full force and effect and after the
date of its passage, and it is so ordained

SUBJECT CONGESTION MITIGATION AND AIR QUALITY IMPROVEMENT PROJECT
AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR A
GRADE SEPARATION ON NORTH BEACH STREET AT THE RAILTRAN CROSSING
(PROJECT NO 111-021205)
RECOMMENDATION
It is recommended the City Council
1 Adopt the attached appropriation ordinance increasing estimated receipts and
appropriations in the Special Assessment Fund by 5920,000 from increased revenues, and
2 Authorize the transfer of 5920,000 from the Special Assessment Fund to the Street
Improvements Fund, and
3 Adopt the attached appropriation ordinance increasing estimated receipts and
appropriations in the Street Improvements Fund by 5920,000 from increased revenues for
the purpose of congestion mitigation and air quality improvements with the Texas
Department of Transportation (TxDOT), and
4 Authorize the City Manager to execute a Congestion Mitigation and Air Quality
Improvement Agreement with the TxDOT for a grade separation on North Beach at the
RAILTRAN crossing at an estimated cost of 5920,000
DISCUSSION
The Intermodal Transportation Efficiency Act of 1991 (ISTEA), established a congestion
mitigation and air quality improvement program (CMAQ) to contribute to the attainment of a
natural ambient air quality standard On November 30, 1994, the Texas Transportation
Commission passed Minute Order 104667 which authorized the grade separation project on
North Beach Street at the RAILTRAN crossing through the State Transportation improvement
Program
The Texas Department of Transportation (TxDOT) has prepared an agreement which details the
responsibilities of both the City of Fort Worth and TxDOT in the development of this project The
City is responsible for the design of the grade separation improvements, securing any needed
rights-of-way, and adjusting or relocating utilities TxDOT will advertise, award and inspect
construction of the project

The project is estimated to cost 52,000,000 The federal share will not exceed fifty-four percent
(54%) of the actual cost of the project Costs in excess of the federal share will be borne by the
City of Fort Worth The City's share of the cost is currently estimated to be 5920,000 Upon
execution of the agreement, the City must remit payment in the amount of 59,200 to TxDOT for
their review of engineering documentation and other incidental costs Approximately sixty (60)
days prior to TxDOT's awarding of the construction contract, the City will be required to fund
the balance of the City's share of the project cost
The RAILTRAN railroad crossing of North Beach Street is located approximately 1,500 ft south
of Airport Freeway North Beach Street is a heav,ly traveled major arterial street The need to
construct a grade separation at this location will only intensify when the RAILTRAN track is
carrying commuter traffic Staff plans to hire a consultant to do an initial feasibility study to
determine the most cost effective manner of separating N Beach Street and the RAILTRAN
tracks Both an overpass and an underpass will be evaluated The effect of the project on
adjacent private businesses is of critical concern in the further development of this project
FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that upon the approval of the above recommendations
and adoption of the attached appropriations ordinances, funds required will be available in the
Street Improvement Fund The cash balance in the Special Assessment Fund after this transfer
will be 53,587,964
