C/~~~ AN ORDINANCE AMENDING THE CODE OF THE CITY OF FORT WORTH (1986), AS AMENDED, BY THE AMENDMENT OF CHAPTER 19 "LIBRARIES", SECTION 19-26 "FEES FOR CERTAIN NON-RESIDENT USERS", RENAMING SUCH SECTION "USE OF LIBRARY BY NONRESIDENTS"; REVISING THE FEE AND USE SCHEDULE FOR NONRESIDENTS; AND REVISING THE DEFINITIONS OF CERTAIN NONRESIDENT CLASSIFICATIONS; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the Code of the City of Fort Worth, Texas (1986), as amended, is amended through the amendment of Chapter 19, "Libraries", Section 19-26, "Fees for certain non-resident users", so that such section shall hereafter read as follows: Sec. 19-26. Use of library by nonresidents. (a) Certain nonresidents shall pay a fee or fees in order to borrow materials or use services of the Fort Worth Public Library, according to the following schedule: Classification Use Fee Nonresident Donor Unrestricted, subject None to Section 19-26(c) Nonresident Individual Library Materials -- Up to 3 items borrowed $ 5.00 Up to 7 items borrowed $10.00 Up to 18 items borrowed $25.00 Up to 40 items borrowed $50.00 - 1 - Library Services None Nonresident Institution Nonresident Student Nonresident Volunteer Library Materials -- $150.00/ Up to 50 items borrowed annually per month Library Services -- $150.00/ Use of one service annually per month Both of the above $300.001 annually Unlimited number of $30.00/ educationally related annually Library Materials and Services, subject to Section 19-26(c) Unrestricted, subject None to Section 19-26(c) (b) Payment of nonresident user fees shall not preclude payment of any regularaly assessed fees which may be required for the use of library materials or services. (c) For purposes of this section, the following definitions and policies shall apply: Library materials. Any book, pamphlet, periodical, paper, sound recording, film, videocassette or other property that is subject to removal from the library through through the customary check-out procedure of such library. Library services. Services shall include, but not be limited to, use of conference rooms, meeting rooms, auditorium facilities, and tours and programs sponsored by the library. Nonresident individual. An individual who does not reside or own property located within the corporate limits of the City of Fort Worth. Nonresident institution. A corporation, partnership, organization or other form of business entity that does not have its offices or own property located within the corporate limits of the City of Fort Worth. - 2 - Nonresident donor. A nonresident individual who donates one hundred dollars ( $100.00 ) or more to the Fort Worth Public Library, the Fort Worth Public Library Foundation or the Friends of the Fort Worth Public Library. A nonresident donor shall receive a maximum of one (1) library card entitling the donor to borrow library materials or use library services free of charge during the time that the card is valid. Such card shall be valid for one (1) year following receipt of the donation for every one hundred dollars ($100.00) donated; provided, however, that such card shall not be valid for more than five ( 5 ) years at any given time, regardless of the amount donated. Nonresident student. A nonresident individual who is currently enrolled in any formally recognized educational institution, subject to verification by library staff. A nonresident student may only borrow library materials and use library services that are related to his or her current educational pursuits. Library administrators shall make the final determination as to whether a particular material or service is educationally related. Nonresident volunteer. A nonresident individual who has completed one hundred (100} hours of volunteer service to the Fort Worth Public Library as a participant in the VALUE volunteer program. A nonresident volunteer shall receive a maximum of one (1) library card entitling the volunteer to borrow library materials or use library services free of charge during the time that the card is valid. Such card shall be valid far one (1) year following completion of the above one hundred (100) hours of volunteer service and may be renewed upon completion of an additional one hundred (100) hours of such volunteer service. (d) Nonresident status and other policies relating to this section shall be determined according to procedures established by the Fort Worth Public Library. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such - 3 - Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall be in full force and effect after its passage, and it is so ordained.
