SUBJECT VACATION OF STREET RIGHTS-OF-WAY SECOND AND FOURTH STREETS I
(BETWEEN ELM STREET AND CRUMP STREET)
RECOMMENDATION
It is recommende that the City Council adopt the attached Ordinance vacating Second Street
between Lots 3~~lock 30, Original Town, and Lots 1 thru 4, Block 1, Gillon -Crump Addition,
and Fourth Street between Lots 5 thru 8, Block 3, Gillon -Crump Addition, and Lots 1 & 2,
Moore Thornton Addition as recommended by the City Plan Commission on July 26, 1995
DISCUSSION
Mr Jim Dunaway, consultant, representing Downtown Fort Worth Initiatives, Inc ,owners of all
adjacent property, requests that the City vacate Second and Fourth Streets as described above
Reviewing City departments and private utility companies have raised no objections to this
request
It is not customary for the vacation of a street right-of-way to take effect prior to the
administrative approval for the filing of the required replat in the Tarrant County Plat Records
However, at the request of the petitioner, appropriate language has been included in the draft
ordinance which provides that the street vacation and the release of the fee therein would not
become effective unless and until a final plat reflecting the vacation is approved by the City and
filed in the Tarrant County Plat Records The adopted ordinance further provides that in the event
that the plat is not approved by the City and filed in the plat records within 180 days following
the date of adoption, the ordinance would become null and void and the vacation, abandonment,
closure and extinguishment of the street rights-of-way will not take effect
This request is located in COUNCIL DISTRICT NUMBER 9
FISCAL INFORMATION/CERTIFICATION
The Land Agent for the City of Fort Worth has determined that an acceptable consideration for
the proposed rights-of-way vacations shall be established at time of property replat based on
circumstances of the situation at that time
