sented contemporaneously with this ordinance is hereby expressly

explanation of the purposes and intent of the Council in their
adoption of this ordinance. In addition, it is expressly stated

upon the promotion of a Lieutenant into the newly created Captain's

tutional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the

sosJSCT ADJUST AUTHORIZED CIVIL SERVICE STRENGTH IN THE POLICE DEPARTMENT
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance specifying the authorized
positions in the Police Department, increasing by one the number of authorized Captain positions
and decreasing the number of authorized Lieutenant positions by one
DISCUSSION-
The authorized strength of the Police Department as adopted in the 1995-96 budget includes
twelve (12) Captain positions and forty-nine {49) Lieutenant positions. This ordinance would
delete one Lieutenant position and add one Captain position, thereby adjusting the Captain
positions to thirteen (13) and Lieutenants to Forty-eight {48) The Captain position would be
placed in command of the Internal Affairs Division of the Department.
The investigative responsibilities associated with the Internal Affairs function have become
increasingly more complex including criminal cases where the actor is alleged to be a Police
Officer and providing the investigative support involving litigation against the Police Department.
This command position is also responsible for reviewing policy and procedure guidelines
applicable to each investigation to ensure that current practices are consistent with departmental
needs and for initiating both appropriate changes in guidelines and recommended training both
on an individual and departmental basis In view of this situation, the proper level of command
for the Internal Affairs Division is that of a Captain Although the recommended change is
justifiable on its own merits, this action, if approved will increase the number of women in
command level positions as the next Lieutenant to be promoted to Captain is a female
The cost of this position for the remainder of the fiscal year is 55,222 and can be absorbed by
the Internal Affairs Division of the Police Department The following will be the adjusted civil
service strength in the Police Department
Current Adjusted
Deputy Chief 5 5
Captain 12 13
Lieutenant 49 48
Sergeant 124 124
