AN ORDINANCE CALLING AND ORDERING AN ELECTION
TO BE HELD ON SATURDAY, MAY 6, 1995, FOR THE
PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS
OF THE CITY OF FORT WORTH A PROPOSITION
AUTHORIZING THE SALE OR EXCHANGE OF PUBLIC
PARK LAND LOCATED IN THE JOHN F. HEATH SURVEY,
ABSTRACT NO. 641, TARRANT COUNTY, TEXAS, AND
BEING A PORTION OF LOT 4, BLOCK 2, BALL RANCH
ADDITION, AN ADDITION TO THE CITY OF FORT
WORTH, TEXAS, AS RECORDED IN VOLUME 388/178,
PAGE 32, COUNTY RECORDS, TARRANT COUNTY,
TEXAS, SAME ALSO BEING A PORTION OF THAT TRACT
AS DESCRIBED BY DEED TO THE CITY OF FORT WORTH
AND RECORDED IN VOLUME 6772, PAGE 418, COUNTY
RECORDS, TARRANT COUNTY, TEXAS.
WHEREAS, the City of Fort Worth heretofore acquired certain
land situated within the City of Fort Worth, Tarrant County, Texas,
for public park use, said land being described more particularly
herein; and
WHEREAS, the City Council of the City of Fort Worth desires to
submit to the qualified voters of the City a proposition
authorizing the sale or exchange of said public park land;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION I.
That in accordance with the Charter of the City of Fort Worth
and the Constitution and laws of the State of Texas, an election is
hereby called and ordered for Saturday, May 6, 1995, at which
election the qualified voters of the City may vote for or against
the proposition authorizing the sale or exchange of a certain 8.646
acre tract of public park land, said land being located in the City
of Fort Worth and described more particularly as follows:
LEGAL DESCRIPTION
Being a tract of land situated in the John F. Heath Survey,
Abstract No. 641, Tarrant County, Texas and being a portion of Lot
4, Block 2, Rall Ranch Addition, an addition to the City of Fort
Worth as recorded in Volume 388/178, Page 32, County Records,
Tarrant County, Texas, same also being a portion of that tract as
described by Deed to City of Fort Worth and recorded in Volume
6772, page 418, said County Records, said tract being more
particularly described by metes and bounds as follows:
Beginning at a 5/8 inch iron rod found at the northwest corner of
Lot 2, Block 2 of said Rall Ranch Addition, said point being in the
easterly right-of-way line of Bryant-Irvin Road (120' public right-
of-way) ,
Thence 30° 00' 00" E, 763.00 feet alone said easterly right-of-way
line to a 5/8 inch iron with cap stamped "Carter & Burgess" set,
the beginning of a curve to the right;
Thence 22.02 feet along the arc of said curve to the right and
continuing along said easterly right-of-way line through a central
angle of 01° 05' 16", a radius of 1160.00 feet and a long chord of
N 30° 32' 38" E, 22.02 feet to a 5/8 inch iron rod with cap stamped
"Carter & Burgess" set,
Thence S 58° 54' 44" E, 73.52 feet to a 5/8 inch iron rod with cap
stamped "Carter & Burgess" set,
Thence S 25° 29' 04" E, 142.96 feet to a 5/8 inch iron rod with cap
stamped "Carter & Burgess" set,
Thence 38° 41' 14" E, 343.24 feet to a 5/8 inch iron rod with cap
stamped "Carter & Burgess" set,
Thence S 21° 21' 44" E, 221.20 feet to a 5/8 inch iron rod with cap
stamped "Carter & Burgess" set,
Thence S 17° 37' 45" E, 197.10 feet to a 5/8 inch iron rod with cap
stamped "Carter & Burgess" set,
Thence S 62° 47' 32" E, 87.04 feet to a 5/8 inch iron rod found,
the northeast corner of Lot 3, Block 2, Rall,Ranch addition (Volume
388/178, Page 32),
Thence N 78° 45' 00" W, 968.00 feet along the northerly line of
said Lots 3 and 2 of Block 2 to the point of beginning and
containing 8.646 acres of land, more or less.
SECTION II.
That the proposition to be submitted to the voters at the
election on May 6, 1995, shall read as follows:
"The sale or exchange by the City of Fort Worth of
a designated 8.646 acres of public park land
located in the John F. Heath Survey, Abstract No.
641, Tarrant County, Texas, and being a portion of
Lot 4, Block 2, Rall Ranch Addition, an addition to
the City of Fort Worth, Texas."

SECTION III.
That all voters who favor the proposition to sell or exchange
the above described property shall vote "For" the sale or exchange,
and all voters who oppose the proposition to sell or exchange the
above described property shall vote "Against" the sale or exchange.
SECTION IV.
That the proposition as hereinafter set forth, if approved by
a majority of the qualified voters of the City voting in said
election, shall authorize the City of Fort Worth, through its City
Council, to sell or exchange the 1'and described in Section I hereof
in accordance with the laws and ordinances of the City of Fort
Worth and the State of Texas.
SECTION V.
That the City Secretary of the City shall prepare the official
ballot in accordance with Sections 52.072 and 52.073 of the Texas
Election Code, which ballot shall be used in said election and
shall contain the proposition hereinabove set forth. Said ballot
shall be printed in English and in Spanish for use in said
election.
SECTION VI.
That the City Secretary of the City of Fort Worth shall
furnish election officials said ballots and voting equipment,
together with any other forms, blanks or instructions in accordance
with the Charter of the City of Fort Worth, Texas, and the laws of
the State of Texas, insofar as same are applicable, and with the
provisions of this ordinance.
SECTION VII.
That the polls shall be kept open from seven o'clock A.M.
until seven o'clock P.M., on Saturday, May 6, 1995, and that due
return shall be made to the City Council showing the number of
votes cast for and against the subject proposition.
SECTION VIII.
That the location of the polling places for the election on
the subject proposition, except insofar as they may be changed by
the City Council, are set forth on Exhibit "A" attached hereto and
made part hereof.
SECTION IX.
That the City Council shall appoint a Presiding Judge and an
Alternate Presiding Judge for each precinct or portion thereof
within the City.

Each presiding judge shall appoint not less than two nor more
than eight qualified election clerks to serve and assist in
conducting said election, provided that, if the Presiding Judge
actually serves as expected, the Alternate Presiding Judge shall be
one of such clerks.
SECTION X.
A. An electronic voting system, as defined in Chapter 121 of
the Texas Election Code, as amended, shall be used for voting at
the regular polling places at said election and for counting the
ballots and the tabulation of the results. The conduct of the
election and the use of the electronic voting system shall be in
accordance with the Texas Election Code, as amended.
B. The Office of the Tarrant County Elections Administrator,
Tarrant County Courthouse, 100 Weatherford, Fort Worth, Texas
76196, is hereby established as the Central Counting Station for
the ballots cast in said election.
C. Robert Parten, having knowledge and experience in the
conduct of elections with the electronic voting system for which
the Central Counting Station is established, and being a registered
voter of the City of Fort Worth, is hereby appointed as the Manager
of the Central Counting Station. The Manager shall be in charge of
overall administration of the Central Counting Station and the
general supervision of the personnel working at said Station.
D. Germaine Williams, being trained in the operation of the
automatic tabulating equipment installed at the Central Counting
Station, is hereby appointed Tabulation Supervisor. The Tabulation
Supervisor shall be in charge of the operation of the automatic
tabulating equipment.
E. The appointments of Lynda Schafer, Donna Marks and Linda
Funkhouser as Assistants to the Tabulation Supervisor are hereby
approved. They shall assist the Tabulation Supervisor in the
operation of the automatic tabulating equipment as directed by the
Tabulation Supervisor.
F. Patricia Benavides is hereby appointed as Presiding Judge
of the Central Counting Station. She shall maintain order at the
Central Counting Station and shall have such authority as may be
prescribed by the Texas Election Code, as amended.
SECTION XI.
That Robert Parten, Tarrant County Elections Administrator,
shall conduct and shall be the clerk for early voting at said
election. That Alice Church, City Secretary of the City of Fort
Worth, will serve as chief deputy early voting clerk. Early voting
shall be conducted by two methods:

A. Voting by personal appearance; and
B. Voting by mail.
An electronic voting system, as defined by Chapter 121 of the
Texas Election Code, as amended, shall be used for early voting.
SECTION XII.
Early voting by personal appearance shall be conducted
beginning April 17, 1995, and shall continue through May 2, 1995.
Such early voting shall be conducted at the following locations at

In addition to the above, early voting by personal appearance will
be conducted at all of the above locations from 7:00 a.m. to 7:00
p.m. on Saturday, April 29; Monday, May 1; and Tuesday, May 2; and
from 11:00 a.m. to 4:00 p.m. on Sunday, April 30, 1995.
Section XIII.
The Early Voting Ballot Board is hereby created to process
early voting results, and Jeanne Lyons is hereby appointed as
Presiding Judge. The Presiding Judge shall appoint at least two
other members to such Board.
SECTION XIV.
That said election shall be held under the provisions of the
Charter of the City of Fort Worth, Texas, and the Constitution and
laws of the State of Texas, insofar as same may be applicable, and
all persons qualified to vote in said City under the laws of this
State regulating this election shall be allowed to vote.
SECTION XV.
This ordinance shall constitute the proclamation, call, notice
and ordinance calling and ordering said election.
SECTION XVI.
That notice of said election shall be given by: (1) publishing
a copy of this ordinance, in English and in Spanish, at least once,
not earlier than the 30th day or later than the 10th day before
election day, in a newspaper published in the said City; and (2)
not later than the 21st day before election day, posting a copy of
this ordinance, in English and in Spanish, on the City's bulletin
board used for posting notices of the meetings of the Fort Worth
City Council.
SECTION XVII.
That the way and manner of holding said election, the notice
given therefor, the polling places, the personnel and the officers,
the precinct judges, and substitutes therefor, who are to hold
same, and all details connected with the holding of the election

shall be provided for and arranged by the City Secretary; that the
proper notice and publication of this notice, proclamation and
ordinance, shall only be cumulative of and in addition to the
statutory notice of said election as herein provided; and that any
omission or irregularity in the publication of this notice,
proclamation and ordinance, or in the signing of same, shall not in
any way affect or invalidate such election.
SECTION XVIII.
That in all respects, said election shall be conducted in
accordance with the Texas Election Code, as amended.
SECTION XIX.
That it is hereby officially found and determined that the
meeting at which this ordinance was adopted and said election was
called was open to the public and public notice of the time, place
and purpose of said meeting-was given, all as required by Chapter
551 of the Texas Government Code.
SECTION XX.
That this ordinance, election order, proclamation and notice
shall take effect and be in full force and effect from and after
the date of its passage, said date being the 16th day of March.,
1995, and it is so ordained.
