HomeMy WebLinkAboutOrdinance 12269~, ~, Ordinance No ~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER COMMERCIAL PAPER FUND IN THE AMOUNT OF $17,290 00 FOR THE PURPOSE OF FUNDING AMENDMENT NO 2 TO ENGINEERING AGREEMENT WITH TURNER, COLLIE & BRADEN, INC , FOR SANITARY SEWER MAIN 170 REPLACEMENT AND DRAINAGE AREA REHABILITATION; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT°WORTH, TEXAS ~.,~ SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1995-96 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations,in the General Fund in the amount of $17,290 00 for the purpose of funding Amendment No 2 to an engineering agreement with Turner, Collie & Braden, Inc , for Sanitary Sewer Main 170 Replacement and Drainage Area Rehabilitation SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect SECTION 3 That this ordinance shall be cumulative of Ordinance No 12074 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is so ordained APPROVED AS TO FORM AND LEGALITY L~ Assistant City Attorney Date ~l-~ I-Gis Adopted Effective City of Fort Worth, Texas Mayor and Council Communication DATE RSFSRSNCS LOG NAMS PAGS Nnr~$R **C-15141 11 /21 /95 30TURNER 1 of 2„ .- svsJSCT APPROPRIATION ORDINANCE AND AMENDMENT NO 2 TO ENGINEERING AGREEMENT WITH TURNER, COLLIE & BRADEN, INC ,FOR SANITARY SEWER MAIN 170 REPLACEMENT AND DRAINAGE AREA REHABILITATION RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to transfer 517,290 00 from Water and Sewer Operating Fund to the Sewer Commercial Paper Fund, and 2 Adopt the attached appropriations ordinance increasing estimated receipts and appropriations in the Commercial Paper Fund in the amount of 517,290 00 from increased revenue, and 3 Authorize the City Manager to execute an amendment to City Secretary Contract No 20065, a professional services contract with Turner Collie & Braden, Inc increasing the contract amount by 517,290 00, from 5258,932 OOto 5276,222 00 DISCUSSION Sanitary Sewer Main 170 is part of the Integrated Wet Weather Wastewater Management Program to comply with an Administrative Order from the US Environmental Protection Agency to eliminate sewer overflows and bypasses in the city's wastewater collection system The EPA has a scheduled construction completion date of February 1, 1996 for this project On December 7, 1993 (M&C C-14102), the City Council authorized the City Manager to execute a professional services contract with Turner Collie & Braden, Inc , to prepare plans and contract documents for Sanitary Sewer Main 170 Replacement and Drainage Area Rehabilitation The total amount approved to do the work was 5238,932 00 On April 26, 1994 (M&C C-14274) the City Council authorized the City Manager to execute Amendment No 1, for surveying and engineering services necessary to design twenty-one additional line segments for a fee of 5 20,000 00 This project was scheduled to be constructed under two phases However, due to easement acquisition delays on a portion of phase 1, a third phase is proposed If approved, the phases will include ° Phase 2 - sewerline replacement through Meadowbrook Golf Course The bid opening was October 12, 1995 ° Phase 1 - sewerline replacement south of Meadowbraok Golf Course ° Phase 3 - includes all manhole rehabilitation work (initially included in phase 1 } City of Fort Worth Texas Mayor and Council Communication DATE REFERENCE LOG NAME PAGE Nur~$R **C-15141 11/21 /95 30TURNER 2 of 2 SUBJECT APPROPRIATION ORDINANCE AND AMENDMENT NO 2 TO ENGINEERING AGREEMENT WITH TURNER, COLLIE & BRADEN, INC ,FOR SANITARY SEWER MAIN 170 REPLACEMENT AND DRAINAGE AREA REHABILITATION The manhole rehabilitation work (Phase 3) includes various manholes throughout the drainage basin Since this work is essentially complete, it can be advertised as a separate project This work, along with the previously advertised Phase 2 will allow the city to meet the EPA's schedule for the majority of the project The work under Phase I involves replacements / relocations in residential areas During the design, it was determined that 42 additional easement instruments were needed for one or more of following reasons ° the sanitary sewer line was relocated away from an existing structure thus, requiring an easement for the new location ° the existing easement language "sufficiently wide" was changed to a specific width and a metes and bounds description was included ° the existing easement area was insufficient to construct or maintain the new sanitary sewer Turner Collie & Braden, Inc ,proposes to prepare the 42 additional easement parcels and separate the manhole rehabilitation work for a fee not to exceed 517,290 00 Staff considers this fee to be fair and reasonable for the work involved This project is located in Council Districts 4 and 5 FISCAL INFORMATION/CERTIFICATION The Director of Fiscal Services certifies that upon approval and completion of recommendation 1, and the adoption of the attached appropriations- ordinance, funds will be available in the current capital budget, as appropriated, of the Sewer Commercial Paper Fund MG a u mitte or City anager s A COUNT CENTER AMOUNT ITY SE RE R Office by: (ro) APPROVED 1 Mike Groomer 6140 / </'Tlf COt1NCIL Originating partment Hea (2) PS46 531200 070460410050 17,290. pt~t' ~~ A.
