HomeMy WebLinkAboutOrdinance 12273r ORDINANCE NO. ~Ol ~ ~~ AN ORDINANCE ESTABLISHING RATES FOR THE COLLECTION OF SOLID WASTE BY THE CITY OF FORT WORTH AND ESTABLISHING RATES FOR AN ENVIRONMENTAL PROTECTION FEE; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILIT.Y CLAUSE; PROVIDING A SAVINGS CLAIISE; PROVIDING THAT THIS ORDINANCE MAY BE PUBLISHED IN PAMPHLET FORM; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth has recodified its environmental regulations into a new Chapter 12.5, and said new chapter includes that part of the City Code formerly known as the "Garbage" Chapter; and WHEREAS, the City of Fort Worth has determined that rates for solid waste collection and the environmental protection fee charged by the City, and formerly included within the "Garbage" Chapter, should not be part of that codification, but should be established by a separate ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. Rates for the collection and disposal of solid waste by the City of Fort Worth, and for the environmental protection fee as established by Chapter 12.5, Article VIII, of the City Code, shall be as follows: A. Collection and Disposal Service Rates. In this equation, base rate means the rate charged for one container per number of service days. (cj Commercial garbage and rubbish -- City- furnished 3-cubic-yard containers: NUMBER OF SERVICE DAYS PER WEEK 2 3 4 5 6 # OF CONTAINERS 1 $116.00 $174.00 $232.00 $ 290.00 $ 348.00 2 232.00 348.00 464.00 580.00 696.00 3 348.00 522.00 696.00 870.00 1,044.00 4 464.00 696.00 928.00 1,160.00 1,392.00 (2) The Director of City Services shall charge collection customers for special services as follows: (a) IInscheduled garbage and rubbish collection: $30.00 per hour (calculated from the time the truck arrives at the customer's property until it departs) + $20.00 per ton (for disposal at City solid waste facility) The Director shall charge a minimum charge of $70..00 for this service ($30.00 for one hour + $40.00 for two tons). 3 (b) IInscheduled brush and bulky waste service: $30.00 per hour (calculated from the time the truck arrives at the customer's property until it departs) + $5.00 per cubic (for disposal at City yard solid waste facility) The Director shall charge a minimum charge of $50.00 for this service ($30.00 for one hour + $20.00 for 4 cubic yards of material). (3) The Director of City Services shall charge persons disposing of solid waste at City solid waste facilities and transfer stations as follows: (a) Fort Worth residents, upon showing a current water bill with a sanitation charge, and hauling normal household rubbish from their residences in autos, pickups or single-axle trailers: NO CHARGE (b) Fort Worth residents not presenting a current water bill indicating a sanitation charge; Fort Worth residents not falling within the load criteria of (d)(1); commercial haulers from Fort Worth and outside Fort Worth; and private haulers from outside Fort Worth: per vehicle load: $20.00 (minimum charge, for up to 2,000 pounds) + $ 5.00 (per five hundred pounds thereafter) (c) Vehicles or trailers whose loads are not covered or secured to prevent littering: $ 3.00 surcharge per vehicle (d) Fort Worth residents disposing of tires at the City landfill: $ 2.00 per passenger vehicle tire $ 5.00 per truck tire 4 B. Environmental Protection Fee. The Director of City Services shall charge a separate fee of $0.50 per month to each customer per service address. Such fee shall be shown as the "environmental protection fee." BECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this. ordinance are severable, and, if any phrase., clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. All rights and remedies of the City of Fort Worth, Texas are expressly saved as to any and all violations of the provisions of 5 the ordinances amended in Section 1, which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same. shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 5. The City Secretary of the City of Fort Worth, Texas is hereby authorized to publish this ordinance in pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof, as provided in Chapter XXV, Section 3, of the Charter of the City of Fort Worth, Texas. SECTION 6. This ordinance shall be in full force and effect after its passage, and it is so ordained.
