AN ORDINANCE VACATING, ABANDONING, CLOSING AND
EXTINGUISHING A FIFTEEN (15) FOOT WIDE SANITARY SEWER
EASEMENT AND A TWENTY (20) FOOT WIDE SANITARY SEWER
EASEMENT LOCATED WITHIN THE RIVER PARK ADDITION TO THE
CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE
IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
j SECTION 1
THAT a sanitary sewer easement measuring fifteen (15) feet in width, with a
maximum length of four hundred seventeen and five one-hundreds (417 05) feet, as said
easement contains six thousand, two hundred eighteen (6,218) square feet and is located
on Lot 1, Block 2, River Park Addition, as recorded in Volume 388-152, Page 34 of the
Tarrant County Deed Records, and as more specifically described in Exhibit A attached
hereto and incorporated herein by reference and a sanitary sewer easement as recorded
in Volume 7117, Page 1706 of the Tarrant County Deed Records, measuring twenty (20)
feet in width, with a maximum length of one hundred six and fifty-three tenths (106 53) feet,
as said easement contains one thousand, six hundred fifty-seven (1,657) square feet and
is located on Lot 1, Block 2, River Park Addition, as said lot and block are recorded in
Volume 388-152, Page 34 of the Tarrant County Deed Records, and as more specifically
described in Exhibit B attached hereto and incorporated herein by reference, be and the
same is vacated, abandoned and permanently closed and extinguished.
SECTION 2.
That the fee to the land in the above described vacated easements are hereby
released and shall revert to the adjacent owner as provided by law
SECTION 3
That all ordinances or parts of ordinances in conflict herewith are hereby repealed
SECTION 4
That this ordinance shall take effect and be in full force and effect from and after the
date of its passage, and it is so ordained

Being a 6218 Square feet tract of land and being part of a 15 feet utility easement as recorded in
Volume 388-152, Page 34 of the Tarrant County Deed Records, and part of Lot 1, Block 2, River
Park Addition, an addition to the City of Fort Worth, Texas as recorded by deed m Volume 388-
152, Page 34 of the Tarrant County Deed Records and approxunately 6 miles southwest of the
Tarrant County Courthouse and is more particularly described by metes and bounds as follows:
Commencing at a 5/8 inch iron rod found for the southwest comer of Lot 1, Block 2, of said River
Park Addition, said uon rod is m the north line of Lot 2, Block 2, of said River Park Addition.
THENCE North 59 degrees 29 minutes 00 seconds East of a distance of 209 67 feet with the
common line ofI.ot 1, Block 2 and Lot 2, Block 2, of said River Park Addition to a 5/8 inch uon rod
called for and found for corner;
THENCE North 71 degrees 22 mnutes 00 seconds East, a distance of 9 49 feet with the common
line of Lot 1, Block 2 and Lot 2, Block 2, of said River Park Addition, to the southwest comer of
said 15 feet utility easement,
THENCE North 16 degrees 26 minutes 47 seconds West, a distance of 145 23 feet along the

RECOMMENDATION
(t is recommended that the City Council adopt the attached ordinance vacating the following
easements
1 A sanitary sewer easement measuring fifteen (15) feet in width, with a maximum length
of four hundred seventeen and five one-hundreds (417 05) feet, as said easement contains
six thousand, two hundred eighteen (6,218) square feet and is located on Lot 1, Block 2,
River Park Addition, as recorded in Volume 388-152, Page 34 of the Tarrant County Deed
Records, and

DISCUSSION
Jay B Sparkes & Company, owner of the subject property, has requested that the above
identified utility easements be vacated in order to facilitate the construction of an apartment
complex on the property The subject easements contain sanitary sewer, however, an
acceptable arrangement has been made for its relocation Reviewing City departments and
private utility companies have raised no objections to this request A satisfactory replat has been
submitted
