AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $2,909,286 FOR THE PURPOSE OF INCREASING FUNDING WITH DFW RAILTRAN SYSTEM AND THE MISSOURI PACIFIC RAILROAD COMPANY FOR THE CONSTRUCTION OF CAPACITY IMPROVEMENTS IN MOCKINGBIRD YARD, DALLAS, TEXAS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1994-95 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $2,909,286 for the purpose of increasing funds with DFW RAILTRAN SYSTEM to pay for design and construction improvements to the Mockingbird yard SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgement shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect SECTION 3 That this ordinance shall be cumulative of Ordinance No 11645 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect and be in full City Manager to execute an agreement w+th Missouri Pacific Railroad Company (MP) for the construction of certain capac+ty improvements in Mockingbird Yard, Dallas, Texas for the +mplementat+on of Phase I Commuter Ra+l Service, and 2 Accept funds transfer from the City of Dallas RAILTRAN Office in the amount of $2,909,286, and 3 Adopt the attached appropriations ordinance increasing estimated receipts and appropriations by 52,909,286 from increased revenues, and 4 Authorize the use of the funds to pay for design and construction improvements to the Mockingbird Yard DISCUSSION Section 3 3 of the Joint Use Agreement between the Cities of Dallas and Fort Worth and the MP on August 16, 1993, gives MP exclusive use of the Mockingbird Yard for both rail and rail-related purposes Certain improvements within Mockingbird Yard were identified in Schedule A of the 1993 Joint Use Agreement which were determined to be necessary for the co-existence of freight and passenger service in Phase i The proposed agreement will provide for the preliminary engineering, final design, and construction of these improvements Under the proposed agreement, MP will 1 Competitively bid all work not performed by MP's own forces 2 Provide to RAILTRAN all construction documents 3 Comply with the Cities' Disadvantaged or Minorities and Women Business Enterprise Programs in the selection of subcontracting firms Project design and construction will not exceed 52,909,286 All liability, insurance, and indemnification provisions of the Joint Use Agreement is incorporated into the proposed receipt of Congestion Mitigation/Air Quality funds from the federal government FISCAL INFORMATION/CERTIFICATION The Director of Fiscal Services certifies that after receipt of funds from the Dallas RAILTRAN account to the Fort Worth RAILTRAN account in the amount of 52,909,286, sufficient funds will be available in the current operating budget of the Special Trust Fund The City of Fort Worth
