HomeMy WebLinkAboutOrdinance 12192ORDINANCE NO ~~<~-~oC AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL ASSESSMENT DISTRICT FUND IN THE AMOUNT OF $85,474 FOR THE PURPOSE OF PROVIDING FISCAL YEAR 1995-96 FUNDING FOR IMPROVEMENT DISTRICT NO 4, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND .PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 1995-96 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Assessment District Fund in t11e amount of $85,474 for the purpose of providing fiscal year 1995-96 funding for Improvement District No. 4. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 12074 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APPROVED AS TO FORM ND LEGALITY City Attorney ~~' ~ ~ Da et ~~ ' ~ - ~~ Adopted Effective City of Fort Worth, Texas Mayor and Council Communication 10/03/95 BH-0148 13PID4 ~ 1 of 2 $~~~ APPROPRIATION ORDINANCE AND BENEFIT HEARING FOR FORT WORTH PUBLIC IMPROVEMENT DISTRICT NO. 4 AND LEVYING OF ASSESSMENTS FOR FISCAL YEAR 1995-96 RECOMMENDATION: It is recommended that the City Council take the following action regarding Fort Worth Improvement District No. 4: 1 Hold a benefit hearing regarding the proposed property assessments for fiscal year 1995-96 on October 3, 1995, and 2 Close the benefit hearing, and 3 Adopt the attached ordinance which levies the proposed assessments, and 4 Adopt the attached appropriations ordinance increasing estimated receipts and appropriations by 585,474 in the Special Assessment District Fund from increased revenues. DISCUSSION: On September 19, 1995, the Council adopted M&C G-11229 which directed that certain improvements and/or services (the "improvements") shall be provided in Fort Worth Improvement District No 4 during the 1995-96 fiscal year It also adopted the proposed assessment roll and provided notice of this benefit hearing. The improvements to be provided and the costs thereof are Total Cost To Be Assessed Maintenance and Landscaping 5211,083 00 575,474.00 Security Patrols 19,000 00 0 00 City Administrative Fee 10,000 00 10,000 00 Replacement Reserve 1,000 00 0 00 Operating Expenses 5,000.00 0 00 Contingency 1,000 00 0 00 Homeowners Association 100.00 0.00 Total 5247,183 00 585,474 00 The 5161,709 difference between total cost and assessments reflects a subsidy of 5121,088 by the contractor, Hillwood Property Company , and a direct reimbursement of 540,621 from the City of Fort Worth for park maintenance. City of Fort Worth, Texas Mayor and Council- Communication- DATB 10/03/95 RBFBRSNCB NII>fIBBR BH-0148 LOO NAB 13PID4 PAt38 2 of 2 sosJSCT APPROPRIATION ORDINANCE AND BENEFIT HEARING FOR FORT WORTH PUBLIC IMPROVEMENT DISTRICT NO. 4 AND LEVYING OF ASSESSMENTS FOR FISCAL YEAR 1995-96 All costs of improvements shall be assessed against private property located in the district and the owners of the property The City Manager has filed with the City Secretary a proposed assessment roll and an estimate of the assessments against each parcel Based on the appraised value of the property and considering the benefits to be received from the proposed improvements, it is the opinion of the City staff that each parcel of property will be enhanced in value by an amount equal to or more than the proposed assessments upon completion of the improvements in accordance with the contract.
