AN ORDINANCE AMENDING THE CODE OF THE CITY OF FORT WORTH
(1986), AS AMENDED, BY CREATING A DEPARTMENT OF
ENGINEERING; CREATING THE OFFICE OF DIRECTOR OF
ENGINEERING; SPECIFYING THE DUTIES OF THE DEPARTMENT AND
THE DIRECTOR; PROVIDING FOR THE APPOINTMENT AND REMOVAL
OF EMPLOYEES BY THE DIRECTOR; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES AND CODE
PROVISIONS NOT IN CONFLICT WITH THIS ORDINANCE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council finds, upon recommendation of the City
Manager, that the Engineering functions of the Department of
Transportation and Public Works and the Water Department, and all
functions of the Real Property Division of the Development
Department should be merged and incorporated into a new and
additional department; and
WHEREAS, the City Council deems it necessary for the efficient
operation of the municipal government to create and establish a
Department of Engineering;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1
That a new Chapter 12A of the Code of the City of Fort Worth, Texas
(1986), as amended, shall be, and the same is hereby established,
which new chapter shall read and be as follows:
CHAPTER 12A
DEPARTMENT OF ENGINEERING
ARTICLE I - IN GENERAL
Section 12A-1. Department established and organized.
That a Department of Engineering is hereby established. The
Department shall be under the supervision of the Director of
Engineering, who shall be subject to appointment and removal by the
City Manager. The salary of the Director of Engineering shall be
in accordance with the Compensation Plan of the City. The Director
of the Department of Engineering shall be a professional engineer
registered and licensed to practice his/her profession in the State
of Texas .
Section 12A-2. Responsibilities generally.
The Director of Engineering shall be responsible for enforcement of
this chapter and for providing planning, design, construction

inspection, project management, and related engineering services
for the City's infrastructure projects managed by the Department of
Engineering.
Section 12A-3. Duties of the department.
The Department of Engineering shall have the following duties:
(1) The Director of the Department shall act to coordinate
activities within the Department. The Director shall provide
overall management functions for the Department, including contract
management, fiscal control, personnel/safety programs, and
administration of the City's infrastructure improvement projects in
cooperation with other City departments.
(2) 'The Director of the Department of Engineering shall serve as
the City Engineer for the City, or he/she may appoint an employee
of the Department to serve as City Engineer; such employee shall be
a professional engineer registered and licensed to practice his/her
profession in the State of Texas. The City Engineer shall approve
all plans and specifications relating to the construction,
reconstruction, repair, or maintenance of public or private
facilities located on, under, above or along city property and
rights-of-way, such approval to be evidenced only by his/her
signature on such plans and specifications. No such work shall be
commenced unless and until such approval has been obtained.
(3) The Department shall be responsible for enforcing compliance
with City construction contract provisions and specifications by
performing recurring inspections during construction of City
projects. The Department shall be structured as an internal
service fund and as such, establish rates to recover cost of
service from other City departments. Costs will be allocated to
other City departments based upon actual level of services provided
by the Department of Engineering for the respective departments.
(4) The Department shall be responsible for providing survey
services as requested by other City departments.
(5) The Department shall be responsible for the engineering design
and construction of City infrastructure improvement projects as
requested and in cooperation with other City departments.. and which
are not otherwise covered in Chapters 30 and 35 of the City of Fort
Worth Code.
(6) The Department shall be responsible for the acquisition of all
land, easements, and any other real property issues relating to the
City of Fort Worth.
(7) The Director of Engineering is hereby appointed the City of
Fort Worth floodplain administrator.

SECTION 2
That it is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any section, paragraph,
sentence, clause or phrase of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining sections, paragraphs, sentences, clauses or
phrases of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional section, paragraph, sentence, clause or
phrase.
SECTION 3
That this ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth (1986), as
amended, except where the provisions of this ordinance are in
direct conflict with provisions of such ordinances and such Code,
in which event conflicting provisions of such ordinances and such
Code are hereby repealed.
SECTION 4
That this ordinance shall take effect immediately from and after
the date of its passage, and it is so ordained.

RECOMMENDATION
It is .recommended that the City Council adopt the attached ordinance amending the code of the
City of Fort Worth (1986) as amended, and creating a Department of Engineering '
DISCUSSION
On October 1, 1992, the engineering functions of the Department of Transportation and Public
Works and the Water Department and all functions of the Real Property Division of the
Development Department were merged and incorporated into a new department l'he
recommended ordinance formally establishes the Department of Engineering, creates the Office
of the Director and amends City Code to reflect these organizational changes The Department
of Engineering is currently in its second year of successful operation
