HomeMy WebLinkAboutOrdinance 11706y=~ ~z ® ~ s~ ORDINANCE NO ~~7D~o AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE, ORDINANCE NO 3011, AS AMENDED, SAME BEING AN ORDINANCE REGULATING AND RESTRICTING THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION, AND FOR SUCH PURPOSES DIVIDING THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO ~ CARRY OUT THESE REGULATIONS AND SHOWING SUCH DISTRICTS AND THE BOUNDARIES THEREOF UPON "DISTRICT MAPS", PROVIDING FOR INTERPRETATION, PURPOSE AND CONFLICT, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES, PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENAL CLAUSE, PROVIDING FOR PUBLICATION AND NAMING AN EFFECTIVE DATE SECTION 1 That Ordinance No 301 1, as amended, be and is hereby amended so that the permitted uses in the hereinafter described areas be altered, changed, and amended as follows Z-94-075 Lots 14 and 15 and North ten feet of Lot 13, Block 11, John C Ryan South Addition From "PD/SU" Planned Development/Specific Use for a retail auto parts and supply facility with no service, self-service or repair of motor vehicles to "E" Commercial Lots 9 and 16, Block 11, John C Ryan South Addition From "PD/SU" Planned Development/Specific Use for a retail auto parts and supply facility with no service, self-service or repair of motor vehicles to "B" Two-Family (1716 West Berry Street) Z-94-091 Lot B, Block 1, Fort Worth Osteopathic Hospital Addition From "C" Multi-Family to "CF'' Community Facilities (1051 Haskell Avenue) Z-94-092 Lot 16R, Block 2, Zilhman's Addition From "E-R" Restricted to "CF" Community Facilities (3608 Mattison Avenue) Z-94-093 East 1 /2 of Lot 12, Block 1, B M Page Addition From "B" Two-Family to "B/HC" Two-Family/Historic & Cultural Subdistrict (2314 Lipscomb Street) Z-94-094 BEING a 5 025 acre tract of land situated in the A J Huitt Survey, Abstract Number 709, City of Fort Worth, Tarrant County, Texas and being a portion of Lot 1, Block 2, Huie Addition, an addition to the City of Fort Worth as recorded in Plat Volume 388/189, Page 29, County Records, Tarrant County, Texas, said 5 025 acre tract of land being more particularly described by metes and bounds as follows BEGINNING at a 5/8 inch iron rod with cap stamped "Carter & Burgess," the intersection of the southerly right-of-way line of State Highway No 183 (a variable width public right-of-way) with the easterly right-of-way line of FAA Boulevard (a 68 foot wide public right-of-way), also being the northwest corner of said Lot 1, Block 2, THENCE South 89° 52' 49" East, along the southerly right-of-way line of said State Highway No 183, 400 00 feet to a 518 inch iron rod with cap stamped "Carter & Burgess", THENCE South 00° 07' 11 " West leaving said southerly right-of-way line 550 00 feet to a 5/8 inch iron rod with cap stamped "Carter & Burgess", THENCE North 89° 52' 49" West, 375 35 feet to a 5/8 inch iron rod with cap stamped "Carter & Burgess" in the easterly right-of-way line of the aforementioned FAA Boulevard, said point being the beginning of anon-tangent curve to the right whose radius is 382 00 feet and whose long chord bears North 10° 13' 41 " West, 137 23 feet; THENCE in a northeasterly direction, along said curve to the right, through a central angle of 86° 20' 37", an arc distance of 64 29 feet to a 1 /2 inch iron rod found, said point being in the said south right-of- way line of David Strickland Road, THENCE North 89° 58' 25" West, along said south line of David Strickland Road, a distance of 482 37 feet to the POINT OF BEGINNING and containing 15 89 acres of land From "I" Light Industrial and "MH" Mobile Home Park to "A" One- Family (5301-5401 Parker Henderson Road) Z-94-098 Block 6, Stonegate Addition From "G" Commercia{ to "D" Multi-Family (2501-2599 South Hulen Street) Z-94-101 Lot 1, Block 1, Meadowbrook Village Addition From "C" Multi-Family and "F-R" Restricted Commercial to "E" Commercial (5900 Ramey Avenue) SECTION 2 That the zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and general welfare of the community They have been designed to lessen congestion in the streets, to secure safety from fire, panic, flood and other dangers, to provide adequate light and air, to prevent overcrowding of land, to avoid undue concentration of population, to facilitate the adequate provisions of transportation, water, sewerage, parks and other public requirements They have been made after full and complete public hearing with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of a building and encouraging the most appropriate use of land throughout the community SECTION 3 That this ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of such ordinances, except in those instances where provisions of such ordinances are in direct conflict with the provisions of this ordinance SECTION 4 That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of Ordinance No 3011 or of any amendments thereto that have accrued at the time of the effective date of this ordinance, and as to such accrued violations, and all pending litigation, both civil or criminal, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts SECTION 5 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional. by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section SECTION 6 That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2000 00) for each offense Each day that a violation is permitted to exist shall constitute a separate offense SECTION 7. That the City Secretary of the City of Fort Worth, Texas is hereby directed to publish this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by V T C A Local Government Code Subsection 52 013 SECTION 8. That this ordinance shall be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained. APPROVED AS TO FORM AND LEGALITY.
