HomeMy WebLinkAboutOrdinance 11508~~ ORDINANCE NO ~~~~~ AN ORDINANCE APPROPRIATING $60,000.00 TO THE GENERAL FUND AND DECREASING THE UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT FOR THE PURPOSE OF FUNDING A CONTRACT RELATIVE TO THE EMPOWERMENT ZONE AND ENTERPRISE COMMUNITY APPLICATIONS, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1993- 94 and in the Budget of the City Manager, there shall also be increased appropriations in the General Fund in the amount of $60,000.00; thereby decreasing the unreserved, undesignated fund balance by the same amount, fox the purpose of funding a contract with Fulbright & Jaworski to provide technical and professional assistance in completion of Empowerment Zone and Enterprise Community applications. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No 11379 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. It is recommended that the City Council Adopt the attached supplemental appropriations ordinance increasing appropriations in the General Fund by 560,000 00 and decreasing the unreserved, undesignated Fund balance by the same amount, and 2 Authorize the City Manager to enter into a contract with the law firm of Fulbright & Jaworski to provide technical and professional assistance in completion of Empowerment Zone and Enterprise Community applications, and 3 Adopt the attached Resolution fixing in advance, as far as practicable, the sum to be paid Fulbright &Jaworski for their services, in an amount not to exceed 560,000 00 DISCUSSION On August 13, 1993, the U S Congress passed the Omnibus Budget Reconciliation Act of 1993 which included the enabling legislation for the federal government's Empowerment Zone and Enterprise Community program. The legislation provides for 6 urban empowerment zones nation wide and 65 urban enterprise communities The Department of Housing & Urban Development (HUD) is charged with review, selection and designation of urban zones Empowerment Zone designees are eligible to receive up to 5100 million in Social Service Block Grants (SSBGs) in addition to numerous tax incentives available to businesses choosing to operate in the zones Enterprise Communities are eligible for 53 million in SSBGs and a lesser number of tax incentives Both empowerment zones and enterprise communities are designed to address the high poverty areas of the nation's cities and rural areas The application process for both empowerment zone and enterprise community designation involves a great deal of data collection, public input and strategic planning Because the applications are due June 30, 1994, a great deal of work must be completed in a relatively short amount of time Currently, the cities of Fort Worth and Dallas are planning a joint empowerment zone application In addition to this joint effort, the City of Fort Worth will pursue a separate enterprise community designation for only the City of Fort Worth t~~ Printed on recycled paper -.1 City of Fort Worth, 7"exas Mayor and Council Communication 02/22/94 DER C-14196 02ZONE ~ 2 of 3 SUBJECT AUTHORIZE THE CITY MANAGER TO ENTER INTO A CONTRACT WITH FULBRIGHT & JAWORSKI FOR ASSISTANCE WITH EMPOWERMENT ZONE & ENTERPRISE COMMUNITY APPLICATIONS Therefore, City staff may be compiling two separate applications Due to the numerous requirements to be met in the application and the fact that staff anticipates compiling two applications, the assistance of Fulbright &Jaworski will be essential to ensure this two-track application process will be completed in a timely manner Fulbright and Jaworski, through Ms Jane Macon, will perform the following activities under this professional services contract 1 Interface with HUD to obtain clarification/explanation of rules regarding empowerment zone or enterprise community application 2 1 If necessary, provide written amendments to current regulations to insure a more favorable response to Fort Worth application(s) 3 Meet with HUD representatives concerning designation of Fort Worth application once submitted 4 Structure the strategic planning process in such a way as to ensure the application will be complete and final by June 30, 1994 5 Assist with scheduling and administration of public Bearings including notification to participants and location selection 6 Oversee development of entire application (including strategic plan) and insure the application complies with federal regulations 7 Review application for correctness and thoroughness during both "draft" and "final" stages 8 Pursue and obtain approval and endorsement of Fort Worth application with State of Texas representatives Attached as Exhibit "A" is a schedule which shows the law firm's hourly rates The firm will comply with the City's Disadvantaged Business Enterprise policy ~~ Printed on recycled paper ~•i City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE LO(; NAME PAt3E NUI~ER C-14196 02/22/94 02ZONE 3 of 3 svs~cT AUTHORIZE THE CITY MANAGER TO ENTER INTO A CONTRACT WITH FULBRIGHT & JAWORSKI FOR ASSISTANCE WITH EMPOWERMENT ZONE & ENTERPRISE COMMUNITY APPLICATIONS FISCAL INFORMATION/CERTIFICATION.
