AN ORDINANCE AMENDING ARTICLE IV OF CHAPTER 2
OF THE CODE OF THE CITY OF FORT WORTH (1986),
AS AMENDED, BY ADDING THERETO DIVISION 6,
WHICH DIVISION PROVIDES FOR THE ESTABLISHMENT
AND REGULATION OF A DEPARTMENT OF RISK
MANAGEMENT AND FOR THE APPOINTMENT OF A
DIRECTOR THEREOF; PROVIDING A SEVERABILITY
CLAUSE; REPEALING ORDINANCES IN CONFLICT
THEREWITH; MAKING THIS ORDINANCE CUMULATIVE OF
OTHER ORDINANCES; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS.
SECTION 1.
That Article IV of Chapter 2 of the Code of the City of Fort
Worth (I986), as amended, is hereby amended by adding thereto
Division 6, consisting of Sections 2-164 through 2-166, and reading
as follows:
Sec. 2-164 Established; director.
The Department of Risk Management is hereby established, which
department shall be under the supervision of the Director of Risk
Management, who shall be subject to appointment and removal by the
City Manager. The salary of the Director of Risk Management shall
be in accordance with the compensation plan of the City.
Sec. 2-165 Appointment of employees.
The Director of Risk Management shall have the power to
appoint, employ and remove such officers, assistants, employees and
personnel as he may deem necessary for the efficient administration
of the affairs of the Department of Risk Management and to
prescribe and fix their duties, scope of authority and
qualifications.
Sec 2-166 Duties of director.
The Director of Risk Management shall be responsible for
coordinating the City's efforts in loss identification, reduction,
and prevention programs through administration of the City's
worker's compensation program; employee occupational health and
safety program; general, automobile, and law enforcement liability
claims adjusting program and litigation arising from such claims;
and property and casualty self-insurance and/or commercial
insurance program. The City's program of group life and medical
benefits for employees, former employees and their eligible

dependents also shall be administered by the Director of Risk
Management, as shall the administration of the City's unemployment
compensation program, The Director of Risk Management shall
additionally perform any other function assigned by the City
Manager to the extent authorized under the Charter of the City and
within the guidelines as have been or may be from time to time
adopted by the City Council applicable to risk management,
unemployment compensation, or group life and/or medical benefits
SECTION 2.
That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and, if any phrase,
clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs
and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation in this
ordinance of any such unconstitutional phrase, clause, sentence,
paragraph or section.
SECTION 3
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth (1986) , as
amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and
such Code are hereby repealed.
SECTION 4.
That this ordinance shall take effect immediately from and
after the date of its passage, and it is so ordained.

SUBJECT ORDINANCE ESTABLISHING THE DEPARTMENT OF RISK MANAGEMENT
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance establishing the
Department of Risk Management
DISCUSSION
Recently, it was discovered that several operating departments have not been established in the
City Charter or by ordinance One such department is the Department of Risk Management In
order to provide legal responsibility and organizational clarity, it is necessary that the City Council
adopt the attached ordinance establishing the Department of Risk Management, providing for the
appointment of its director, providing for the employment of personnel, and prescribing the
director's duties
