ORDINANCE NO. ~~
AN ORDINANCE AMENDING SECTION 2-9, "CONTRACT EXECUTION;
CHANGE ORDERS", OF THE CODE OF THE CITY OF FORT WORTH,
TEXAS (1986), AS AMENDED, TO ADD A NEW PROVISION TO
SECTION (C) THEREOF, IN ORDER TO ALLOW THE EXECUTION OF
CERTAIN CONTRACTS INVOLVING THE LEASE, LICENSE OR USE OF
FACILITIES AT THE WILL ROGERS MEMORIAL CENTER WITHOUT
NECESSITY OF CITY COUNCIL APPROVAL; PROVIDING THIS
ORDINANCE IS CUMULATIVE OF ALL ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; AND NAMING AN EFFECTIVE DATE.
BE IT 'ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 2-9 (c) of the Code of the City of Fort Worth,
Texas (1986), as amended, is hereby amended by adding the following
underlined provisions so that said subsection (c) shall hereafter
read as follows:
"(c) Any contract or other legal instrument for the
sale, purchase or lease of real property shall be
approved by the City Council prior to execution or
acceptance by the City Manager; provided, however,
that leases of City property for a term not
exceeding thirty (30) days and involving an amount
not exceeding. Fifteen Thousand Dollars ($15,000)
may be executed by City Manager without City
Council approval. Provided further. that anv
SECTION 2.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas (1986),
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such. ordinances and such
Code, in which event conflicting provisions of such ordinances and
such Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence
paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 4.
This ordinance shall be in full force and effect from and
after its passage and it is so ordained.

RECOMMENDATION
it is recommended that the City Council approve the attached ordinance which amends Section
2-9 of the City Code of the City of Fort Worth which permits certain contracts relating to the
leasing, licensing, or uses at the Will Rogers Memorial Center to be executed without City
Council approval ,
DISCUSSION
The Public Events Department is responsible for operation and leasing of the Will Rogers
Memorial Center arid has been successful in attracting high profile national and international
events to maximize the uses of the complex Often in negotiation of multi-year contractual
commitment from these user groups it is necessary to provide different business terms to attract
and retain these events Although the Wi11 Rogers Complex offers a superior venue for these
events, there is considerable competition for them from. other public events facilities in other
cities, and therefore, the nature of the public events business necessitates "proprietary"
information being included in the contracts
The City Attorney's Office has recently ruled that the Public Events contracts are not exempted
from the Section 2-9 (c) as revised which reads
"(c1 Any contract or other legal instrument for the sale, purchase, or
lease of real property shall be approved by the City Council prior to
execution or acceptance by the City Manager, provided, however.,
that leases of -City property for a term not exceeding thirty (301 days
and involving an amount not exceeding fifteen thousand dollars

Council approval "
The proposed amendment adds
('Provided further, that any contract or other legal instrument for the lease, license or
use of facilities at the Will Rogers Memorial Center may be executed by the City
Manager without City Council approval "
