AN ORDINANCE AMENDING SECTIONS 35-56(a), 35-56(b), 35-56(c), 35-56(d), 36-
101(a), 35-101(c), 35-101(d), ADDING SECTIONS 35-39(h), 35-39(i), 35-39(j), 35-
39(k), 35-56(i), DELETING 35-39(a)(3) OF CHAPTER 35 OF THE CODE OF THE
CITY OF FORT WORTH (1986), AS AMENDED, BY REVISING AND ADDING
CERTAIN RATES AND CHARGES, MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES, REPEALING ALL ORDINANCES AND PROVISIONS
OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH, PROVIDING A
SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING
AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH.
SECTION 1.
35 56(a) is amended by adding the term "director" to the list of definitions, such
definition to be as follows "Director shall mean -the director of the water department of
the City of Fort Worth or his authorized representative"
SECTION 2.
That Section 35-56(b) of Chapter 35 of the Code of the Crty of Fort Worth (1986), as
amended, is hereby amended to be and read as follows
"(b) The following schedule of rates per month, or fraction thereof, shall
be the charges to all residential and nonresidential customers for
furnishing water to such customers located within the city The residential
monthly volume charge for water service shall be the charges to the
residential customer class, as defined in this chapter, for furnishing water
to residential water customers located wrthm the city The nonresidential
monthly volume charge for water service shall be the charges to the
nonresidential customer class, as defined in this chapter for furnishing
water to nonresidential water customers located within the city "

SECTION 3.
That Section 35-56(c) of Chapter 35 of the Code of the City of Fort Worth (1986), as
amended, is hereby amended to be and read as follows.
"(c) The following schedule of rates per month or fraction thereof shall
be the basis for determimng charges to all customers for rendering sanitary
sewerage service, where the sewage produced by such customer is a
normal strength wastewater (two hundred ten (210) mg/1 B O.D and two
hundred forty (240) mg/1 suspended solids) and where such customer is
located within the city
RATES FOR SEWERAGE SERVICE ONLY
(1) A monthly service charge shall be charged to all customers m the
amount of four dollars and fifty cents ($4.50).
(2) A monthly volume charge shall also be charged to residential
customers m the amount of one dollar and twenty-four cents ($1.24) per
one hundred (100) cubic feet of water used, and to nonresidential/non
monitored customers in the amount of one dollar and twenty-four ($1.24)
per one hundred (100) cubic feet of water used, or waste water produced,
as more specifically set forth hereinafter
"The monthly volume charges for residential class customers will be based on the
individual customer's average monthly water use during the preceding winter quarter
months of December, January and February The volumes used to compute these charges
are based on the amount of water used by the residential class customer as measured by a
meter Where no preceding winter quarter average is available from records, the director
shall estimate a volume to be used for this monthly volume charge
"The monthly charges to the nonresidential/non monitored customers will be based on
total water use as measured by appropriate meters, with the provision that if a customer
can prove, to the satisfaction of the director, that a significant portion of the metered
water usage does not enter the sanitary sewers, the customer will be charged fo only that
volume entering the sewers, as determined by a method approved by the director "
SECTION 4.
That Section 35-56(d) of Chapter 35 of the Code of the City of Fort Worth (1986), as
amended, is hereby amended to be and read as follows.
"(d) The director shall establish a monitored group class, consisting of those
customers whose wastewater strength is, m his judgment, abnormally high or
whose wastewater contains limited substances or materials, and charges to
customers m this class shall be computed m accord with the following five-part
rate schedule
MONITORED GROUP

"The monitoring charge shall consist of all cost for personnel, material and equipment
used to collect and analyze samples from the customer wastewater to determine the
strength of the wastewater produced and, when appropriate, to inspect pretreatment
facilities, to administer pretreatment permit systems and to enforce ordinance
requirements. Pretreatment requirements primarily affect mdustnes which are subject to
40 CFR, Part 403, General Pretreatment Regulations.
"This schedule shall replace all other charges previously made for industrial waste
strength."
SECTION 5.
That Section 35-101(a) of Chapter 35 of the Code of the City of Fort Worth (1986), as
amended, is hereby amended to be and read as follows
"(a) All nondomestic users which discharge into the san2tary sewer system of the
authority shall be grouped according to the following definitions
Group I -Significant Industrial Users.
Group II -Commercial Facilities and Small Industrial Users. Those
commercial facilities and mdustnal users which are not included in
Group I. Examples include, but are not limited to, automotive
service shops, small food processors and photographic developing
shops.
Group III -Classed High Strength Users. Restaurants, car washes or other
businesses which can be classed according to any average strength
or abnormal strength of their wastewater
Group IV -Wastewater Haulers. Septage and chemical toilet waste
haulers desiring to discharge into the authority's sanitary sewage
system. Waste must be generaged within the authority's service
area.
Group V -Ground Water Remediation Dischargers. Dischargers who are
retrieving contaminated underground water, pretreatmg such water,
and then discharging into the sanitary sewer system."
SECTION 6.
That subsection 35-101(c) and (d) of Chapter 35 of the Code of the City of Fort Worth
(1886), as amended, are hereby amended to and be read as follows
"(c) No new Group I, Group IV or Group V user shall be allowed to discharge
until issued a valid permrt/contract.
"(d) The authority will evaluate the completed application and data fiirmshed by
the discharger and may require additional information. If, after evaluation the
application is deemed satisfactory then an appropriate permrt/contract (wastewater
discharge or ground water remediation discharge) will be issued. The
permrt/contract shall be subject to the terms and conditions specified herein and
to the regulations of the authority "
SECTION 7.
That Section 35-39 of Chapter 35 of the Code of the City of Fort Worth (1986), as
amended, is hereby further amended by adding subsection 35-39(h), (i), (j), and (k) which
shall be and read as follows
"(h) Resumes. All customers requesting account information and history such as
consumption and associated charges will not be charged for this service unless the
historical information requested exceeds three years. If the information requested
is for the time penod greater than one year, a charge of fifteen dollars ($15) for
each year of additional research requested will be added to the customer's
account."
"(i) Meter Testing. All customers requesting a meter test will be provided with
one meter test per year, per customer account, at no charge. Any customer

"(j) After Hours Service Connection Charge. All customers requesting the
connection of service on the same day as the request was made or outside of
normal business hours (8.00 A.M. - 5.00 P.M. Monday -Friday) will be assessed
a charge often dollars ($10) for field action for the same day and/or after hours
service which will be added to the customer's account."
"(k) Hanging Past Due Notification Tags on Multi-Units. Any commercial
multi-unit customer with a delinquent amount which is scheduled for termination
service, will be charged a fee for hanging customer notification tags on each unit
hours prior to service termination. The fee will be added to the customer's
account.
"The fee structure is as follows.
1 - 2 Units
3 - 4 Units
5 - 25 Units
26 - 75 Units
75 - 125 Units
126 - 150 Units
151 and above

SECTION 8.
That Section 35-56 of Chapter 35 of the Code of the Crty of Fort Worth (1986), as
amended, is hereby further amended by adding subsection 35-56(I) which shall be and
read as follows
"(i) A permrt/contract fee up to five-thousand dollar ($5,000) will be assessed for
a ground water remediation discharge permit. The term of the permit/contract
shall not exceed two (2) years. In addition to a volume charge based on current
rates, a monthly service fee of four dollars and fifty cents ($4.50) will be
assessed."
SECTION 9.
That section 35-39 of Chapter 35 of the Code of the Crty of Fort Worth (1986), as
amended, is hereby further amended by deleting subsection 35-39(a)(3) relating to
Seasonal Meters.
SECTION 10.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of this
ordinance are m direct conflict with the provisions of such ordinances and such Code, m
which event conflicting provisions of such ordinances and such Code, m which event
conflicting provisions of such ordinances and such Code are hereby repealed.
SECTION 11.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections
of this ordinance, since the same would have been enacted by the C1ty Council without
the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence,
paragraph or section.

SECTION 12.
That this ordinance shall become effective and be in full force and effect from and after
its passage, provided, however, that the increased rates specified herein shall apply to
residential and nonresidential, statements sent by the City of Fort Worth on or after
December 1, 1994, and it is so ordained.

SUBJBCT PROPOSED RETAIL WATER AND WASTEWATER RATE INCREASE
RECOMMENDATION
It is recommended that the City Council approve the attached ordinance which revises water and
wastewater rates, includes fees for specialized services and provides an effective date of billing
the new rates on or after December 1, 1994.
DISCUSSION
On April 19, 1994, the City Council authorized the City Manager to execute a contract with
Financial Concepts and Application, Inc, to conduct a retail cost of service study for water and
wastewater retail rates To assist with decisions about allocating costs on a "fair" and
"equitable" basis to each customer class, a Citizen Advisory Committee was formed consisting
of fourteen members Membership included representatives from neighborhood associations,
commercial customers, large volume water users and industrial customers, developers and
builders, an environmentalist, and non-profit organizations
A total of nine meetings were conducted with the Committee members The responsibilities of
the Committee were to make recommendations to City staff concerning the equity of the rate
structure only, not the amount of any rate increase that might be enacted later.
Based on the Committee's recommendation, aretail cost of service study identified a rate
structure to recover the costs of providing water and wastewater service to our customers The
overall retail increase recommended is 8%, resulting from combined increases of 4 39% for
water and 13 01 % far wastewater Retail water rates have not been increased since November
1989, and wastewater rates were last increased in August 1993.
The following water and wastewater rates are proposed by the Water Department.

The Committee also recommended additional fees for specializing services such as preparation
of billing history (resume), customer requested meter testing, after hours connection charges,
and hanging of past due notify tags on multiple units Additionally, groundwater remediation
permits and monthly charges are addressed
