AN ORDINANCE APPROPRIATING $7,013,650.00 TO THE WATER
AND SEWER OPERATING FUND AND DECREASING THE
UNRESERVED, UNDESIGNATED RETAINED EARNINGS BY THE
SAME AMOUNT FOR THE PURPOSE OF FUNDING A
ENGINEERING AGREEMENT WITH FREESE AND NICHOLS, INC.,
FOR THE INTEGRATED WET WEATHER WASTEWATER
MANAGEMENT PROGRAM, PROVIDING FOR A SEVERABILITY
CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year
1993-94 and in the Budget of the City Manager, there shall also be increased appropriations in the
Water and Sewer Operating Fund in the amount of $7,013,650.00; thereby decreasing the unreserved,
undesignated Retained Earnings by the same amount, for the purpose of funding an engineering
agreement with Freese and Nichols, Inc., for the Integrated Wet Weather Wastewater Management
Program.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no
way impair the remaining portions, sections, or parts of sections of this ordinance, which said
remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 11379 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are
in direct conflict with such other ordinances and appropriations, in which instance said conflicting
provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect and be in full force and effect from and after the date of its passage,
and it is so ordained.

RECOMMENDATION
It is recommended that the City Council
Adopt the attached supplemental appropriations ordinance increasing the Water and Sewer
Operating Fund appropriations by 57,013,650 00 and decreasing the Unreserved,
Undesignated Retained Earnings of the Water and Sewer Operating Fund by the same
amount,
2 Transfer 57,013,650 00 from the Water and Sewer Operating Fund to the Sewer Capital
Projects Fund,
3 Adopt the attached appropriations ordinance increasing estimated receipts and
appropriations by 57,013,650 00 in the Sewer Capital Projects Fund, and
4 Authorize the City Manager to execute an engineering agreement with Freese and Nichols,
Inc , in the amount of 56,988,650 00 for the Integrated Wet Weather Wastewater
Management Program
DISCUSSION
In September, 1993, the U S Environmental Protection Agency (EPA) issued an Administrative
Order (AO) which specified an eight-year compliance schedule to correct the deficiencies in the
wastewater collection system and eliminate sanitary sewer overflows Full compliance is
required by 2001 Freese and Nichols, Inc ,will provide engineering and professional services
for the initial two-year period of the eight-year Program Annual extensions of this engineering
agreement will be subject to re-authorization by the City Council The Freese and Nichols Team
will coordinate the technical and legal aspects of the Program Manager, managerial and technical
tasks Major elements included in this Program include
o Coordination of all inflow/infiltration reduction projects and Capital Improvement
Projects with the various activities of the Program to ensure the overall goals and
objectives are met,

INTEGRATED WET WEATHER WASTEWATER MANAGEMENT PROGRAM
o Formulation of policy and plans to comply with the mandated schedule and to
address the proposed requirements from both EPA and Texas Natural Resource
Conservation Commission,
o Recommendation of policies and action plans to address wholesale and retail
customers through community outreach, advisory committees, public hearings and
media relations,
o Assistance in the planning of the Program financing,
o Establishment of sanitary sewer evaluation survey (SSES) standards and long term
flow monitoring standards,
o Development of an updated wastewater collection system master plan and an
updated wastewater treatment facility plan,
o Technical evaluation of alternative wastewater storage or treatment facility options
which include water quality modeling and effluent reuse evaluations,
o Development of a quality control program to enhance coordination, training and post
construction flow monitoring and testing,
o Preparation of a comprehensive long term data management, operation and
maintenance program,
o Implementation of a program to enhance DBE participation in the design and
construction phases of the program
Funding, in addition to the above fee of 525,000 00, is included for project review
The supplemental appropriation of 56,988,650 00 will be used to fund this engineering
agreement
Freese and Nichols, Inc , is in compliance with the City's DBE policy by committing to 15 71
percent DBE participation
This project is City-wide

FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that, upon adoption of the supplemental appropriations
ordinance, approval of the funds transfer, and adoption of the appropriation ordinance, funds
required for this engineering agreement will be available in the current operating budget of the
Sewer Capital Projects Fund
The unreserved undesignated retained earnings of the Water and Sewer Operating Fund will be
5278,070,361 00 after this supplemental appropriation action is complete
