AN ORDINANCE VACATING, ABANDONING AND CLOSING AND
EXTINGUISHING A UTILITY EASEMENT LOCATED WITHIN THE RIVER
PLAZA COMPLEX OF THE CITY OF FORT WORTH, TEXAS; PROVIDING
FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH.; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the five (5) foot wide utility easement located on Block
1, Lot 3-A-3, River Plaza Complex, as recorded in Volume 388-131,
Page 5 and as more specifically described in Exhibit A attached
hereto be and the same is vacated, abandoned and permanently closed
and extinguished.
SECTION 2.
That the fee to the land in the above described vacated
utility easement is hereby released and shall revert to the
adjacent owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so
ordained.

DESCRIPTION OF PROPOSED VACATED PORTION Of 10 FOOT UTILITY AND DRAINAGE EASEMENT
SITl1ATEQ 1n the City of Fort Worth, Tarrant County, Texas, and being a portion of the
southerly one-half of a 10 foot wide utilil,y and drainage easement across the
northerly part of Lot 3-A-3, Dlock 1, RIPER PLAZA COMPLEX, a5 shown on plat recorded
in Volume 388-231, Page 5, of the Tarrant County Plat Rrcords, said easement being
located adjacent to the southerly line of River Ruri, a dedicated emergency access and
utility easemont across said northerly .part of Lot 3-A-3, and said portion of
easement being more fully described as follows.
BEGINNING at a point in the northeasterly line of said Lot 3-A-3, and the
southwesterly line of Lot 3-A-2 in said Block 1, said point being in the center of
said 10 foot wide utility and drainage easement and lying 43.5 feet South b5 deyrees,
52 minutes East from the most northerly corner of said Lot 3-A-3; ,
THENCE South 65 degrees, 52 minutes East with said northeasterly Tine of Lot 3-A-3
and southwesterly line of Lot 3-A-2, a distance of 5.82 feet to a point in the
southerly line of said 10 foot wlde easement, said point being on a curve whose
center beers North 35 degrees, 36 minutes, 17 sec.unds West, 160.12 feet;
THENCE westerly with said curve and with said southerly line of 10 foul. wide
easement, and concentric with the northerly line of said Lot 3-A-3, a distance of
86.81 feet to the point of intersection of said southerly line of easement with the
east line of a 15 foot wide utility and drainage easement along the west line of said
Lot 3-A-3 and the east line of University Drive (variable width ,right-of-way),
THENCE North 0 degrees, 43 minutes West with said east, line of 15 foot wide utility
and drainage easement, 5.01 feet to the center of said l0 foot wide utility and
drainage easement, said point being on a curve whose center l-ears Nur•I.t, 4 degrees, 40
minutes West, 155.12 feet,
THENCE easterly with said center of 10 foot wide utility and drainage easement and
concentric with said northerly line of Lot 3-A-3, a distance of 80.83 feet to the

SUBJECT VACATION OF A UTILITY EASEMENT RIVER PLAZA COMPLEX, BLOCK 1, LOT 3-A-3

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating a five (5) foot
wide utility easement located on Block 1, Lot 3-A-3, River Plaza Complex, as recorded in Volume
388-131, Page 5, extending from the west lot line of lot 3-A-3 to the northeast lot line of lot 3-A-
3 The subject property is also known as the Fort Worth Residence Inn located at 1701 South
University Drive
DISCUSSION
RFS Partnership, L P ,owner of the subject property, has requested that the above identified
utility easement be vacated in order to eliminate a title cloud caused by the encroachment of an
existing structure onto the subject easement Reviewing City departments and private utility
companies have raised no objections to this request Pursuant to state statute, a public hearing
must precede the ordinance adopting the proposed vacation
This request is located in COUNCIL DISTRICT #9
FISCAL INFORMATION/CERTIFICATION
The Land Agent for the City of Fort Worth has determined that a one dollar fee satisfies the
interest of the City of Fort Worth in this request
