ORDINANCE NO. ~73~
AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE
OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 3011, AS
AMENDED, CODIFIED AS APPENDIX "A" OF THE CODE OF THE CITY
OF FORT WORTH (1986) , AS AMENDED, BY REPEALING SUBSECTION
20.C.39 OF SECTION 20, "BOARD OF ADJUSTMENT", CONCERNING
SPECIAL EXCEPTIONS FOR GROUP HOMES I AND II; PROVIDING
THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE;
PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR
PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, on April 14, 1992 the City Council of the City of
Fort Worth, Texas adopted Ordinance No. 11073, which amended
Section 2-B, " 'CF' Community Facilities District", of Ordinance
No. 3011, the Comprehensive Zoning Ordinance of the City of Fort
Worth, as amended; ,
WHEREAS, pursuant to Ordinance No. 11073 Group Homes I and II
are a principal use in !'CF" Community Facilities Districts and are
permitted. as a matter of right;
WHEREAS, Section 20.C of the Comprehensive Zoning Ordinance,
"Authorized Special Exceptions," sets out uses that may be
permitted by the Board of Adjustment as .special exceptions;
WHEREAS, Subsection 20.C.39 provides that a special exception
is required for the establishment of Group Homes I and II in "CF"
Community Facilities districts, save and except Group Homes for
chemically dependent treatment programs;
' WHEREAS, Subsection 20.C.39 is inconsistent with the
!provisions of Ordinance No. 11073 allowing Group Homes I and II in
"CF" Community Facilities Districts as a principal use;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF FORT WORTH, TEXAS:
SECTION 1.
THAT Ordinance No. 3011, the Comprehensive Zoning of the City
of Fort Worth, as amended, is hereby amended by repealing Section
20.C.39, which reads as follows:
39. Group Homes I and II, save and "CF"
except Group Homes for chemical-
ly dependent treatment programs.
SECTION 2.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas (1986),
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and
such Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared void,
ineffective, or unconstitutional by the valid judgment or decree of
any court of competent jurisdiction, such voidness,
ineffectiveness, or unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
void, ineffective or unconstitutional phrase, clause, sentence,
paragraph or section.
SECTION 4.
The City Secretary of the City of Fort Worth, Texas, is hereby
authorized to publish this ordinance in pamphlet form for general
distribution among the public, and the operative provisions of this
ordinance as so published shall be admissible in evidence in all
courts without further proof than the production thereof, as

provided in Chapter XXV, Section 3, of the Charter of the City of
Fort Worth, Texas.
SECTION 5.
This ordinance shall be in full force and effect from and
after its passage and publication as required by law and it is so
ordained.
