AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE
AMOUNT OF $75,896.00 FOR THE PURPOSE OF ACCEPTING A
CONTRACT WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION FOR ENHANCED ENFORCEMENT OF THE
MANDATORY USE LAW FOR SAFETY BELTS, MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH,
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS.
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year
1994-95 and in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Special Trust Fund in the amount of $75,896.00 or the purpose of accepting a
contract with the Texas Department of Transportation for enhanced enforcement of the Mandatory Use
Law for safety belts.
SECTION 2.
Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent.jurisdiction, such decision, opinion or judgment shall in no
way impair the remaining portions, sections, or parts of sections of this ordinance, which said
remaining provisions shall lie and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 11645 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are
in direct conflict with such other ordinances and appropriations, in which instance said conflicting
provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect and be in full force and effect from and after the date of its passage,
and it is so ordained.

RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to accept the contract with the Texas Department of
Transportation to operate the Occupant Protection STEP for enhanced enforcement of the
Mandatory Use Law for safety belts on an overtime basis in the amount of 565,247 00 and
adopt the attached appropriations ordinance increasing estimated receipts and
appropriations in the Grants Fund by $65,247 00, and
2 Adopt the attached appropriations ordinance increasing estimated receipts and
appropriations in the Special Trust Fund by 575,896 00 from increased revenues, and
3 Authorize the transfer of 575,896 00 from the Special Trust Fund to the Grants Fund for
the City's cash match, and
4 Adopt the attached appropriations ordinance increasing estimated receipts and
appropriations in the Grants Fund by 575,896 00 from increased revenue, and
5 Authorize the City Manager to waive the indirect costs in the amount of $21,772 28 since
__ indirect costs are not allowed by the Texas Department of Transportation, and
6 Authorize the Fisca! Services Department to create a project number in the Grants Fund
DISCUSSION
The Texas Department of Transportation has agreed to provide funds for this project to increase
safety belt use among drivers, front seat passengers and child safety seat use This program will
entail officers, on an overtime basis, working sites on area freeways that have been identified
as having the highest levels of noncompliance with the mandatory use law for safety belts
Different sites will be worked at various hours and days This program will operate in
conjunction with our other contract program entitled Speed All equipment for this program will
be provided from existing resources, and the State will reimburse the City for overtime pay and
mileage expenses at a 50/50 percent ratio (State-50%, City-50%)
The funding period for this program will begin on October 1, 1994 (or. when al( signatures are
obtained on the contracts) and end September 30, 1995
The total contract cost of the Occupant Protection Program is 5141,143 00 The Texas
Department of Transportation will provide funds in the amount of 565,247 00 and the City of

Fort Worth will provide 565,247 00 plus 510,649 00 for retirement fringe benefit The terms
of the State contract do not allow for reimbursement of the 9 22% retirement fringe benefit for
the overtime personnel base salaries therefore, it was not included in the contract total The
funds for the City contribution are available in the Special Trust Fund, Awarded Assets

The Texas Department of Transportation does not provide for any form of indirect costs,
therefore, it will be necessary to waive these charges in the amount of 521,772 28 for the
Occupant Protection Program
FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that upon the approval and execution of all of the above
recommendations, the funds required for this agreement will be available in the current operating
budgets, as appropriated, in the Special Trust and Grants Funds
