AN ORDINANCE REVISING AND AMENDING THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986) AS AMENDED, TO CHANGE THE NAME OF THE "DEPARTMENT OF PARKS AND RECREATION" TO THE "DEPARTMENT OF PARKS AND COMMUNITY SERVICES", RETITLING CHAPTER 24 OF SAID CODE TO "PARKS AND COMMUNITY SERVICES" ; AMENDING THE CODE OF THE CITY OF FORT WORTH TO CONFORM TO THE DEPARTMENTAL NAME CHANGE; AMENDING ARTICLE II "DEPARTMENT" OF CHAPTER 24, BY REVISING SECTIONS 24- 37, AND 24-42, AND ADDING A NEW SECTION 24-45 TO PROVIDE FOR THE INTEGRATION OF THE COMMUNITY SERVICES DIVISION INTO THE DEPARTMENT, AND PROVIDING FOR ADVISORY BOARDS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. (a) That department denominated the "Park and Recreation Department" in Chapter XVIII of the Charter of the City of Fort Worth, Texas as amended shall hereafter be named in the Code of the City of Fort Worth, Texas, as amended (1986) the "Department of Parks and Community Services"; (b) Chapter 24 of the Code of the City of Fort Worth, Texas, as amended (1986) is hereby retitled "Parks and Community services"; (c) The phrases "parks and recreation", and "park and recreation", whenever they appear in Chapter 24 or elsewhere in the entirety of the Fort Worth City Code are hereby amended to "parks and community services" except where "recreation" is followed by the term "area" or a term of similar import. Sections 24-37 and 24-42 of Article II "Department" of Chapter 24 "Parks and Community Services" are hereby further amended and after amendment shall read as follows: SECTION 24-37. APPOINTMENT DUTIES OF DIRECTOR Subject to the approval of the City Manager the Parks and Community Services Director shall be responsible for determining the overall policies, regulations and programs governing acquisition, improvement, maintenance and operation of all public parks, parkways lakes and other recreational areas, and the grounds surrounding all municipal buildings owned or controlled by the City. In addition, the director shall perform such other tasks and administer such programs as may be assigned by the City Manager from time to time for the purpose of promoting the well-being of the community and the citizens of the City of Fort Worth. The Parks and Community Services Director shall be responsible to the City Manager for administration and implementation of the policies established by the City Council in accordance with the provisions of this article. SECTION 24-42. PARKS AND COMMUNITY SERVICES ADVISORY BOARD- APPOINTMENT; MEMBERS The City Council shall appoint a Parks and Community Services Advisory Board to be comprised of citizens to act in an advisory capacity in conjunction with the Parks and Community Services Department. The board shall consist of nine (9) members, who shall serve in places numbered 1 through 9. Members shall serve two-year terms. No member shall serve more than three (3) consecutive two-year terms, and the terms of current members of the board shall be counted toward the limit of terms to be served for purposes of this section. SECTION 3. A new Section 24-45 is hereby added to Article II of Chapter 24 of the Code and shall read as follows: SECTION 24-45. ADDITIONAL ADVISORY BOARDS-APPOINTMENT' MEMBERS' DUTIES The City Council may create by ordinance additional advisory boards to be comprised of citizens to act in an advisory capacity to the City Manager and City Council in conjunction -2- 4 with the Parks and Community Services Department. The members of any such advisory boards shall serve for designated terms, shall serve without compensation and may be removed at any time by the City Council. The ordinance creating the board shall prescribe the duties and responsibilities of the board. SECTION 4. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. -3- "t~' T''k~:.
