AN ORDINANCE AMENDING SECTIONS 25-36, 25-37, AND 25-38 OF ARTICLE III "DEPARTMENT OF HOUSING AND HUMAN SERVICES", CHAPTER 25 "PLANNING", OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1986) AS AMENDED, TO ESTABLISH THE DEPARTMENT OF HOUSING, TO DELETE REFERENCES TO "HUMAN SERVICES", PROVIDING FOR A REFORMULATED GROUP OF DUTIES FOR SAID DEPARTMENT, PROVIDING FOR THE APPOINTMENT OF A DIRECTOR FOR THE HOUSING DEPARTMENT, MAKING PROVISION FOR ADVISORY BOARDS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES CONCERNING IT5 SUBJECT MATTER; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS THAT: SECTION 1. Article III, Sections 25-36, 25-37 and 25-38 of Chapter 25 "Planning" of the Code of the City of Fort Worth, Texas (1986), as amended, is hereby further amended, and after said amendment shall read as follows: ARTICLE III. DEPARTMENT OF HOUSINQ SEC. 25-36. ESTABLISHMENT: DUTIES There is hereby created a department of housing, which department, under the supervision of the director of housing shall be responsible for executing housing programs. Subject to the approval of the City Manager and City Council, the department of housing will provide for the administration of programs and expenditure of funds for housing and neighborhood revitalization with both public and private funds including donations, grants and contracts. SEC. 25-37. APPOINTMENT OF DIRECTOR The director of housing shall have charge of the department. In addition to the duties of Section 25-36, the director shall perform such other tasks as may be assigned by the City Manager from time to time. The director shall be subject to the appointment and removal by the City Manager. The salary of the director shall be in accordance with the compensation plan of the City. SEC.. 25-38. ADVISORY BOARDS (a) The City Council may appoint Advisory Boards to act in an advisory capacity to the City Manager and City Council in conjunction with the Housing Department. The members of any such Advisory Boards shall each serve for designated terms, shall serve without compensation and may be removed at any time by the City Council. (b) The Advisory Boards may review and recommend to the City Manager and City Council measures to meet the housing needs of the City. Recommendations made by the Boards will be presented to the City Manager and City Council for consideration. (c) The Director of Housing or his or her authorized representative shall serve as the non-voting secretary of any Advisory Boards to the department. The secretary shall prepare and have custody of all necessary minutes and records . SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted -2- by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY: ~~City ttorney C ~~ Date: TIC ~/~i/~ ADOPTED • `~ - ~ Z ` EFFECTIVE : 7 `~Z -3- City of Fort Worth, Texas Mayor and Council Communication DATE LO(i NAME I PAGE 04/12/94 13RESTRU 1 of 2 suaJECT REQUIRED ORDINANCE AMENDMENTS TO IMPLEMENT RESTRUCTURING OF HOUSING AND HUMAN SERVICES DEPARTMENT RECOMMENDATION It is recommended that the City Council adopt the attached ordinances changing the name of the Park and Recreation Department to the Parks and Community Services Department, creating the Housing Department, and amending the ordinances that establish the Community Development Council DISCUSSION On February 1, 1994, the City Council received Informal Report No 7796 (attached) which outlined the restructuring of the Housing and Human Services Department (HHS) into a stand alone Housing Department, which anticipated moving the Human Services Division to the Park and Recreation Department, and the administrative staff from HHS to the Fiscal Services Department under a new division that would administer the City's Community Development Block Grant (CDBG) At the February 1 Work Session, the City Council was briefed on the restructuring and was informed of the need to amend certain ordinances to formally implement the restructuring Operationally, the restructuring of HHS has occurred with the Human Services Division transferred to the Park and Recreation Department, the Housing Department is operating with a more focused approach limited to housing needs for low- and moderate-income persons, and administrative staff have physically moved to the Fiscal Services Department to concentrate efforts on administering the City's CDBG funds The attached three ordinances amend the current City Code to (1) Incorporate a name change of the Park and Recreation Department to the Parks and Community Services Departmentto more accurately reflectthe department's mission which will now include human services related functions (2) Establish the Housing Department eliminating references to the Human Services functions under the former Housing and Human Services Department (3) Change the current ordinance relating to the Community Development Council to narrow the scope of the CDC's review to the CDBG grant process The current code gives the Community Development Council first review over all housing .policy and appropriation decisions involving federal grant funds The code was written at a time when the primary source of federal funds received by the City was CDBG funds Under. the. amendments, the CDC will continue to conduct the required public hearing process 8u~ing the _; CDBG budget process The City Council Housing Programs Committee will continue<ao~review~~~ housin ~`' g policy.....-r. -- ------.~.-_- -- --- _ ----- -- __-_, __-.__ ~'Prirrted,on recyGed paper City of Fort Worth, Texas Mayor and Council Communication DATE 04/12/94 REFERENCE NUMBER G1OG21 LOG NAME 13RESTRU PAGE 2 of 2 svBJECT REQUIRED ORDINANCE AMENDMENTS TO IMPLEMENT RESTRUCTURING OF HOUSING AND HUMAN SERVICES DEPARTMENT On March 28, 1994 the Park and Recreation Advisory Board unanimously approved the recornmendation to change the name of the Park and Recreation Department to Parks and Community Services Department On April 15, 1994, the City Council Housing Programs Committee voted to recommend adoption of the proposed ordinances CB m Submitted for City Manager's FUA'D ACCOUNT CENTER AMOUNT CITY SECRETARY Office by: (to) Libby Watson 6140 APPROVED Originating Department Head: CITY COUNCIL Libby Watson 6140 (from) ~PR 12 1994 .. , For Additional Information ~ J Contact: City Saat~t~-o[.Uts~_.
