HomeMy WebLinkAboutOrdinance 18719-07-2009Ordinance No. 18719-07-2009 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF X414,945.00, SUBJECT TO RECEIPT OF AN EXECUTED STATE FUNDED GRANT AGREEMENT WITH THE TEXAS COMMISSION ON ENVIROWENTAL QUAUTY, FOR THE PURPOSE OF FUNDING FISCAL YEAR 2009-2010 COMPLIANCE MONITOR STRATEGY FOR THE AIR QUALITY PROGRAMS: PROVIDING FOR A SEVERABlLITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments far Fiscal Year 2008-2009, there shall aiso be increased estimated receipts and appropriations in the Grants Fund in the amount of $414,945.00, subject to receipt of an executed State Funded Grant Agreement with the Texas Commission on Environmental Quality, for the purpose of funding fiscal year 2009-2010 compliance monitory strategy far air and/ar stage II programs. SECTION 2. That should any portion, section ar part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18283 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. No. 18719-07-2009 DATE: Tuesday, July 14, 20©9 REFERENCE NO.: C-23660 LOG NAME: 52TCEQ COMPLIANCE GRANT FY10 SUDJECT: Authorize the Execution of a State Funded Grant Agreement with the Texas Commission an Environmental Quality for Fiscal Year 2009-2010 Compliance Monitoring Strategy for Air Quality Programs in the Amount of $278,013.00, Authorize Interfund Loan and In-Kind Match and Adopt Appropriation Ordinance RECOMMENDATION: It is recommended that the City Council: 1. Authorize the City Manager to execute the Texas Commission on Environmental Quality State Funded Grant Agreement with the Texas Commission on Environmental Quality for compliance monitoring strategy for the air and/ar Stage II programs with a maximum amount of $278,013.00 for the period beginning September 1, 2009, and ending August 31, 2010, with the option to renew the Agreement for three additional one year periods upon written consent of the parties by an Amendment to this Agreement; 2. Authorize anon-interest bearing interfund loan from the Environmental Operating Fund to the Grant Fund in the amount of $69,503.00 for interim financing for this grant, pending contract execution, to secure program continuation from one grant funding period to the next; 3. Authorize the use of $136,932.00 from the General Fund as an in-kind match for this Amendment; 4. Authorize the Department of Environmental Management to perform the services as specified in the contract; 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grant Fund in the amount of $414,945.00 in Fiscal Year 2009-2010, subject to receipt of an executed State Funded Grant Agreement; and 6, P~~~ply indirect cost at the rate of 21,48 percent in accordance with the Perms ~~f the Slate F~.inded fi-ar~t Agree;r;ent t)~SCUSSlON; ~'~~, , i~ _ ~- -~ ._ cy, , ~~ ~~-~~__, ~'_, ;~ ' ,~ Agreement requires an additional in-kind match of $136,932.OU. The City must provide matching funds such that the combined federal and state i~~~re of the total funding for the City of Fort Worth ~ocai Air Program shall not exceed 67 percent. A portion of the Air Quality Section's General Fund Budget for Fiscai Year 2009-2Q10 will be used for the required in-kind match. Upon approval and acceptance of the grant, City funds will be expended before receipt of grant funds. FISCAL INF4RMATIC?N 1 CERTIFICATIC}N: The Financial Management Services C}irector certifies that upon approval of the above recommendations, receipt of the gra~~t and adoption of the attached appropriation ordinance, funds will be availabie in the current operating budget, as appropriated, of the Grants Fund. Funds will be reimbursed by grantor after expenditures are made. Upon execution of the grant contract and receipt of grant funds, the interFund loan of S69,503.00 will be repaid to the Environmental operating Fund.
