ORDINANCE NO L~_17~~.J AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $976,736.00 FOR THE PURPOSE OF CONTRACTING WITH THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS COMPREHENSIVE ENERGY ASSISTANCE PROGRAM, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 1993-94 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $976,736.00 for the purpose of contracting with the Texas Department of Housing and Community Affairs Comprehensive Energy Assistance Program for Program Year 1995. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No 11379 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY d `q ~ City /torney /-1~fi~9~1 Date' I ' Adopted /l-~~ ~~ Effective City of Fort Worth, Texas Mayor and Counccill Communication DATE REFERENCE NUMBER LOG NAME PAGE 11 /29/94 **C-14587 80TDHCA 1 of 2 SUBJECT CONTRACT WITH THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS (TDHCA) COMPREHENSIVE ENERGY ASSISTANCE PROGRAM FOR PROGRAM YEAR 1995 RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to accept a contract with the Texas Department of Housing and Community Affairs (TDHCA) Comprehensive Energy Assistance Program in the amount of $976,736 00 and adopt the attached appropriations ordinance increasing estimated receipts and appropriations in the Grants Fund by 5976,736 00, and 2 Authorize the Fiscal Services Department, to create a project number in Grants Fund, and 3 Apply indirect cost rates in accordance with the City's Administrative Regulation 3-15 (apply the rate of 18 73 percent, which represents the most recently approved rate for this department and apply the new approved indirect cost rates when available) DISCUSSION The Texas Department of Housing and Community Affairs has notified the City that 5976,736 00 is available for the Comprehensive Energy Assistance Program (CEAP) The CEAP for Fiscal Year 1994-95 has five components 1) Elderly/Disabled assistance, 2) Energy Crisis, 3) Co-pay Assistance, 4) Replacement and Retrofit of Heating and Cooling Systems, and 5) Case Management The allocation is being made with Low Income Home Energy Assistance Program funds to address the needs of low income households in Tarrant County who are paying a disproportionate amount of their income to meet basic energy needs for heating and cooling All households at or below 125% of the Federal Poverty Level will be afforded access to the program All applicant households will be determined eligible according to the income guidelines and program procedures Benefit determinations include the household's income, the household size, the energy consumption and/or the vulnerability of the household and the availability of funds The goals of this program are to 1) address the needs of a household through case management, 2) assist a household in developing goals for self sufficiency, 3) provide a co-pay for a household with an energy burden higher than that of the average household, 4) provide relief to low-income elderly and handicapped occupied households that are subject to high energy costs for home heating and cooling, •=«~ Printed on recycled paper City of Fort Worth, Texas Mayor and CounnciZ Communication DATE 11 /29/94 REFERENCE NUMBER **C-14587 LOG NAME 80TDHCA PAGE 2 of 2 SUBJECT CONTRACT WITH THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS (TDHCA) COMPREHENSIVE ENERGY ASSISTANCE PROGRAM FOR PROGRAM YEAR 1995 5) provide one time assistance in an energy related crisis, and 6) serve 1,440 households benefiting 4,947 persons The Parks and Community Services Department will review all applications at the nine (9) City Community Center facilities Applicants will be notified, by mail, at the completion of the intake process of approval or denial Payments will be made, for eligible clients, directly to the utility or heating and cooling systems repair companies by the City of Fort Worth The Administrative cost is allowed at a rate of 7 22% of the total allocated CEAP amount, totaling 570,520 00 and Case Management at a rate of 6 19%, totaling 560,460 00 The remaining 5845,756 00 will be used for Elderly/Disabled, Energy Crisis, Co-pay and assistance with Replacement and Retrofit of Heating and Cooling Systems for the duration of the contract The indirect cost rate of 18 73% is included in the Administrative, Case Management and Direct Services Budget categories This program is located in all COUNCIL DISTRICTS No matching funds are required from the City FISCAL INFORMATION/CERTIFICATION The Director of Fiscal Services certifies that upon acceptance of this grant, execution of this contract with the Texas Department of Housing and Community Affairs, and adoption of the attached appropriations ordinance, funds required for this project will be available in the current operating budget of the Grants Fund LW I Submitted for City Manager's F[JND ACCOUNP CENTER AMOUNT CITY SECRETARY Office by: (to) Libby Watson 6140 APPROVED Originating Department Head: CITY COUId~f , Richard Zavala, Jr 7275 (from) NUV ~.~ 1994 For Additional Information ~~~ ~~yti,a,~ Contact: City Seos+etatry of ~ Richard Zavala, Jr 7275 dit7 ~)~t wpm' TelR09g =~~ Printed on recycled paper
